LEGAL NOTICE
NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by 14 Cider Mill, LLC to Resource Capital, LLC, dated September 30, 2022, and recorded with the Norfolk County Registry of Deeds in Book 40847 at Page 70; as amended by a certain Notice of Amendment to Note and Loan Docs dated January 25, 2024, and recorded at the said Registry of Deeds in Boook 41718, Page 370, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 10:00 A.M. on the 27th day of February 2026, at 14 Cider Mill Road, Medway, MA 02053, all and singular the premises described in said mortgage,
To wit:
the land in Medway, Norfolk County, Massachusetts, with the buildings thereon on the southeasterly side of Cider Hill Road, a private way, being shown as Lot 9 on a plan entitled “Cider Mill Acres Definitive Subdivision Plan of Land in Medway, Mass. Applicant: Henry Wickett, Scale: 1” – 40’, Date: November 30, 1987, Desimone Surveying Services, Inc.” filed with Norfolk Deeds as Plan No. 663 of 1988, Plan Book 369, to which plan reference may be had for a more particular description of the mortgaged premises.
Said Lot 9 contains 44,617 S.F. according to said plan.
Said premises are subject to a Temporary Turnaround and Snow Removal Easement as shown on said plan.
Said premises are conveyed together with the right to pass and repass over Cider Mill Road for all purposes for which public ways are commonly used in the Town of Medway; subject, however, to the rights of others entitled thereon.
For title of the Mortgagor see Deed of the Estate of Katherine Joyce Wickett – Norfolk Probate and Family Court Docket No. NO22P0657 EA dated September 23, 2022 and recorded herewith.
As affected by Grant of Title 5 Bedroom Count Deed Restriction dated May 3, 2023, and recorded with the Norfolk County Registry of Deeds in Book 41176, Page 250.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of fifteen thousand dollars ($15,000.00) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by wire transfer to Ligris + Associates, P.C., 1188 Centre Street, Newton, MA 02459 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
