MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by David A. Whitcomb and Priscilla J. Whitcomb to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Mortgage Financial Services, Inc., its successors and assigns, dated July 14, 2003 and recorded in Plymouth County Registry of Deeds in Book 25833, Page 62 (the “Mortgage”), as affected by a Loan Modification Agreement dated November 2, 2013, and recorded at said Registry of Deeds in Book 44167, Page 238, and further affected by a Loan Modification Agreement dated March 22, 2017, and recorded at said Registry of Deeds in Book 48311, Page 54, and further affected by a Loan Modification Agreement dated October 21, 2021, and recorded at said Registry of Deeds in Book 56273, Page 316 of which mortgage US Bank Trust National Association, Not In Its Individual Capacity But Solely As Owner Trustee For VRMTG Asset Trust is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc. to Wells Fargo Bank, N.A. dated September 11, 2009 and recorded at said Registry of Deeds in Book 37710, Page 24, and Assignment from Mortgage Electronic Registration Systems, Inc., as nominee for Mortgage Financial Services, Incorporated, its successors and assigns to Wells Fargo Bank, NA dated September 6, 2012 and recorded at said Registry of Deeds in Book 41936, Page 91, and Assignment from Wells Fargo Bank, N.A. to US Bank Trust National Association, Not In Its Individual Capacity But Solely As Owner Trustee For VRMTG Asset Trust dated August 9, 2024 and recorded at said Registry of Deeds in Book 59151, Page 288, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 31 Kenberma Street, Hull, MA 02045 will be sold at a Public Auction at 12:00 PM on March 2, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
The land, together with the buildings thereon, situated on the northerly side of Kenberma Street, in Hull, Plymouth County, Massachusetts, being Lots 880 and 881 as shown on a plan entitled "Plan of Kenberma Park, Nantasket Beach, Hull, Mass.", dated June, 1908, Frank E. Sherry, C.E., which plan is recorded in Plymouth County Registry of Deeds in Plan Book 1, Page 557, said lots being together bounded and described, according to said plan, as follows:
Southerly: by said Kenberma Street, 40 feet;
Westerly: by Lot 879, 100 feet;
Northerly: by land of owners unknown, 40 feet; and
Easterly: by Lot 882, 100 feet.
Containing 4,000 square feet of land, according to said plan.
For mortgagor’s title see deed recorded with the Plymouth County Registry of Deeds in Book 17622, Page 209.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
