By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Paul L. Barrett to Washington Mutual Bank, FA, dated July 9, 2004 and recorded in Norfolk County Registry of Deeds in Book 21290, Page 159 (the “Mortgage”), as affected by a Loan Modification Agreement dated October 19, 2011, and recorded at said Registry of Deeds in Book 29391, Page 385, and further affected by a Loan Modification Agreement dated January 16, 2014, and recorded at said Registry of Deeds in Book 32057, Page 328 of which mortgage U.S. Bank Trust National Association, not in its individual capacity but solely as trustee on behalf of and for the benefit of MEB Loan Trust VII is the present holder by Assignment from Federal Deposit Insurance Corporation, as receiver of Washington Mutual Bank F/K/A Washington Mutual Bank, FA to JPMorgan Chase Bank, National Association dated July 25, 2012 and recorded at said Registry of Deeds in Book 30289, Page 467, and Assignment from JPMorgan Chase Bank, National Association to MEB Loan Trust VII, a Delaware Statutory Trust dated October 26, 2022 and recorded at said Registry of Deeds in Book 40913, Page 227, and Assignment from MEB Loan Trust VII, a Delaware Statutory Trust to U.S. Bank Trust National Association, not in its individual capacity but solely as trustee on behalf of and for the benefit of MEB Loan Trust VII dated April 3, 2025 and recorded at said Registry of Deeds in Book 42335, Page 262, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 738 Jerusalem Road, Cohasset, MA 02025 will be sold at a Public Auction at 10:00 AM on March 4, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
Property Address: 738 Jerusalem Road, Cohasset, Massachusetts
That certain parcel of land, together with the buildings thereon, situate in the Town of Cohasset, Norfolk County, Commonwealth of Massachusetts, being Lot 1, Lot Area 29,992 square feet, 0.69 AC" according to a certain plan entitled "Plan of Land for 738 Jerusalem Road in Cohasset, Mass., scale 1"-20" and being dated May 8, 2003 prepared by Ross Engineering Company, Inc., Professional Engineers-Land Surveyors, for Stephen M. Karvett, Owner, which plan is recorded with the Norfolk County Registry of Deeds at Plan No. 585 of 2003 in Plan Book 513.
Together with the right to use, in common with others entitled thereto, the avenue or private way over land now or formerly of Louvan C. Hyde adjoining the granted premises.
For mortgagor’s title see deed recorded with the Norfolk County Registry of Deeds in Book 21290, Page 158.
The property will be sold subject to the redemption rights in favor of the Internal Revenue Service by virtue of the tax lien(s) recorded in Norfolk County Registry of Deeds in Book 39950, Page 254.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $15,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
