By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Kirk Brown and Jacquelyn Sullivan Brown to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Fremont Investment & Loan, its successors and assigns, dated January 10, 2007 and registered at Plymouth County Registry District of the Land Court as Document No. 616882 and noted on Certificate of Title No. 77830 and recorded in Plymouth County Registry of Deeds in Book 33974, Page 19 (the “Mortgage”) of which mortgage HSBC Bank USA, National Association as Trustee for Ellington Loan Acquisition Trust 2007-2, Mortgage Pass-Through Certificates, Series 2007-2 is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc. to HSBC Bank USA, National Association as Trustee for the holders of the Ellington Loan Acquisition Trust 2007-2, Mortgage Pass-Through Certificates, Series 2007-2 dated June 8, 2011 and recorded at said Registry of Deeds in Book 40014, Page 274, and Assignment from Bank of America, N.A. to Nationstar Mortgage, LLC dated June 28, 2013 and recorded at said Registry of Deeds in Book 43860, Page 202, and Assignment from Mortgage Electronic Registration Systems, Inc. as nominee for Fremont Investment and Loan, its successors and assigns to HSBC Bank USA, N.A., as Trustee for Ellington Loan Acquisition Trust 2007-2 dated October 29, 2014 and recorded at said Registry of Deeds in Book 44964, Page 256, and Assignment from Mortgage Electronic Registration Systems, Inc. as nominee for Fremont Investment & Loan, its successors and assigns to HSBC Bank USA, N.A., as Trustee for Ellington Loan Acquisition Trust 2007-2 dated December 30, 2015 and registered as Document No. 740956 and noted on Certificate of Title No. 77830, and Assignment from Bank of America as attorney in fact for Nationstar Mortgage, LLC to HSBC Bank USA, National Association, as Trustee for the holders of the Ellington Loan Acquisition Trust 2007-2, Mortgage Pass-Through Certificates, Series 2007-2 dated December 30, 2015 and recorded at said Registry of Deeds in Book 46512, Page 54, and Assignment from Mortgage Electronic Registration Systems, Inc. as nominee for Fremont Investment & Loan, its successors and assigns to HSBC Bank USA, N.A., as Trustee for Ellington Loan Acquisition Trust 2007-2 dated June 30, 2016 and recorded at said Registry of Deeds in Book 47156, Page 132, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 6 Weir Street Extension, Hingham, MA 02043 will be sold at a Public Auction at 12:00 PM on June 19, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
Unregistered Land:
A certain parcel of land in Hingham, Plymouth County, Massachusetts, being comprised of both registered and unregistered land and being shown in its entirety as Lot 19 on a plan entitled "Ringbolt Farm at Hingham, Mass., dated December 31, 1980, Loring H. Jacob Company, a division of Boston Survey Consultants", and being duly recorded with the Plymouth County Registry of Deeds as Plan 981 of 1984 in Plan Book 25, Page 166.
Said Lot 19 registered with the Plymouth County Registry District of the Land Court is also shown as Lot 8 on a plan entitled "Subdivision Plan of Land in Hingham, Massachusetts dated September 9, 1985, Loring H. Jacobs Company, a division of Boston Survey Consultants, Inc.", which plan is on file with Certificate of Title No.64452 as Land Court Plan #9081C.
Said Lot 19 is conveyed subject to and with the benefit of all easements, rights, restrictions, and covenants contained in a Declaration of Easements and Covenants dated October 15, 1985, duly recorded with Plymouth Deeds In Book 6460, Page 133 and on file with the Plymouth Registry District of the Land Court as Document No. 248207 as amended.
Said Lot 19 is also conveyed subject to and with the benefit of all rights and obligations as set forth In the Ringbolt Farm Homeowners Association Trust under Declaration of Trust dated October 15, 1985, and duly recorded With Plymouth Deeds in Book 6460, Page 149 and on file with the Plymouth Registry District of the Land Court as Document No. 248209.
the aforementioned Declaration of Easements and Restrictions and the provisions of the Ringbolt Farm Homeowners Association Trust together with any amendments thereto shall constitute easements, restrictions, covenants, and rights, running with the land, and shall bind any person having at any time any Interest or estate in said lot, including family, employees, and invitees, as though such provisions were recited and stipulated at length herein.
This lot has been developed in conformance with an overall hydrologic plan designed to minimize the risk of flooding or other such water problems, and approved by the Hingham Conservation Commission pursuant to the Wetlands Protection Act, M.G.L. Chapter 131, section 40 and the Hingham Wetlands Protection By-Law. Further dredging, filling or grading of any kind is strictly prohibited in areas subject to the provisions of said Act and said By-law after construction as proposed under this Order of Conditions unless subsequently approved in new actions under this Act and By-Law.
Subject to provisions of Conservation Restriction of Ringbolt Farm Associates to the Town of Hingham recorded with Plymouth Deeds in Book 5097, Page 456, and on file with the Plymouth Registry District of the Land Court as Document No. 210380.
Subject to a 20' wide sanitary sewage easement as shown on plan recorded Plymouth Deeds in Plan Book 25, Page 166 and filed as Plan No. 9081-C with Land Court Certificate No. 64452 In the Plymouth Registry District of the Land Court.
Subject to easement to Hingham water Company recorded Plymouth Deeds in Book 6337, Page 300 and filed in the Plymouth Registry District of the Land Court as Document No. 248205.
Subject to easement to Hingham Municipal Lighting Plant and New England Telephone and Telegraph Company recorded Plymouth Deeds in Book 6120. Page 70 and filed in the Plymouth Registry District of the Land Court as Document No. 248206.
Subject to Utility Easement to Paul F. Johnson dated November 10, 1988 to be recorded herewith.
Registered Land:
That certain parcel of land situate in Hingham, in the County of Plymouth and said Commonwealth, described as follows:
Being Lot 8 on subdivision plan #9081C, drawn by Loring H. Jacobs Co., Surveyors, dated September 9, 1985 and September 26, 1985, filed with Certificate of Title No. 2121.
Said Lot is subject to rights and easement acquired by the Old Colony Railroad Company, as granted by deed of Merrell Thomas et al, dated March 12, 1895, duly recorded in Book 689, Page 310.
Said lot is also subject to and has the benefit of certain rights as reserved in a deed from Christopher C. Yule to Robert P. Hutchinson et ux, dated November 10, 1979, filed and registered as Document No. 197818.
Said lot is also subject to an easement from Ringbolt Farm Associates to Hingham Municipal Lighting Plant et al, dated May 24, 1985, filed and registered as document #248206.
So much of said lot as is included within the limits of the area marked slope easement, approximately shown on said plan, is subject to the easements.

The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
