NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
7 Garden Road, Wellesley, MA 02481
By virtue and in execution of the Power of Sale contained in a certain mortgage given by YFO Matthill Properties LLC to CV3 Financial Services LLC dated 7/18/2024 and recorded in the Norfolk County Registry of Deeds at Book 41894, Page 315 ; thereafter assigned to CV3 Bravo Trust said assignment recorded in the Norfolk County Registry of Deeds in Book at Book 41901, Page 491; thereafter further assigned to Wilmington Savings Fund Society FSB , not in its individual capacity but solely as owner trustee of Atlas SP Resi Opportunity Trust IA said assignment recorded in the Norfolk County Registry of Deeds at Book 42066, Page 298; thereafter further assigned to Wilmington Savings Fund Society FSB , not in its individual capacity but solely as owner trustee of ATLX 2025-RTL1 Trust said assignment recorded in the Norfolk County Registry of Deeds in Book at Book 42505, Page 442of which mortgage the undersigned is the present holder for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold by Public Auction at 3:00 p.m. on July 14, 2026 at the mortgaged premises located at 7 Garden Road, Wellesley, MA 02481 all and singular the premises described in said mortgage, To wit:
That certain piece or parcel of land , with the buildings and improvements thereon, situated in Wellesley, Norfolk County, Massachusetts commonly known and numbered as 7 Garden Road and shown as Lot 1C on a plan of land entitled “Plan of Land in Wellesley, Mass.”. Drawn by McCarthy & Sullivan Engineering, Inc. dated December 17, 1984 and recorded as Plan No. 85 of 1985 in Plan Book 319, said Lot 1C being more particularly bounded and described according to said plan, as follows:
NORTHWESTERLY : by Garden Road, in two courses 23.87 feet and 38.70 feet respectively:
NORTHEASTERLY: By land of Charles E. and Bessie P Brown 91.05 feet ;
EASTERLY: by land of said Brown 36.00 feet;
NORTHERLY By land of said Brown 82.80 feet;
EASTERLY : By land of Town of Wellesley 152.64 feet;
SOUTHERLY: By land of James J. and Mary M. Gallagher 50.00 feet;
WESTERLY: By lot 1B 80.94 feet;
SOUTHWESTERLY : By lot 1B 68.50 feet;
WESTERLY : By lot 1B 42.00 feet; and
SOUTHWESTERLY : By lot 1B 83.09 feet.
The premises are conveyed subject to the following easements:
(a) A twenty-five foot wide sewer easement to the Town of Wellesley as shown on said plan recorded said Deeds as Plan No. 85 of 1985 in Plan Book 319;
(b) Footway easement to the Town of Wellesley dated November 20 1981 recorded with said Deeds in Book 5953, Page 24 and shown on a plan of land dated December 2, 1980 and recorded as Plan No. 1100 of 1981 in Plan Book 293, as affected by Abandonment of Town Footway Easement recorded with said Deeds in Book 8252, Page 403; and
(c) Footway easement (an additional grant thereof) from Alshar Realty Trust to the Town of Wellesley, as shown on a plan entitled “Footway Easement, Lot 1C, 7 Garden Road, Wellesley, Massachusetts: Scale : 1”-80’ dated May 4, 1986 by R.F.Field Associates , recorded with said Deeds in Book 7082, Page 531.

Said premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE: A deposit of Ten Thousand Dollars ($ 10,000.00) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. High bidder to sign written memorandum of sale upon acceptance of the high bid. The balance of the purchase price is to be paid by certified or bank check at Philip L. Eiker, PLLC, P.O. Box 1241, Patagonia, AZ 85624 within thirty (30) days from the date of the sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
In the event of an error in this publication, the description of the premises contained in said mortgage shall control. Other terms, if any, to be announced at the sale.
