NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Aileen M. Defilippo and Walburga A. Michalski to Mortgage Electronic Registration Systems, Inc., as nominee for Allied Home Mortgage Capital Corp-Branch 571, dated March 31, 2003, and recorded at the Plymouth County Registry of Deeds in Book 24880, Page 82, of which mortgage the undersigned is the present holder by an assignment of mortgage from Mortgage Electronic Registration Systems, Inc. to Chase Home Finance, LLC, dated November 9, 2010, and recorded at said Deeds in Book 39262, Page 223; by a corrective assignment of mortgage from Mortgage Electronic Registration Systems, Inc., as nominee for Allied Home Mortgage Capital Corp-Branch 571 to Chase Home Finance, LLC, dated August 25, 2017, and recorded at said Deeds in Book 48889, Page 125; by an assignment of mortgage from JPMorgan Chase Bank, National Association successor by merger to Chase Home Finance LLC, to MTGLQ Investors, L.P., dated August 25, 2017, and recorded at said Deeds in Book 48889, Page 128; by an assignment of mortgage from MTGLQ Investors, L.P., to U.S. Bank Trust National Association, as Trustee of the Chalet Series III Trust, dated August 16, 2018, and recorded at said Deeds in Book 50391, Page 111; by an assignment of mortgage from U.S. Bank Trust National Association, as Trustee of the Chalet Series III Trust to U.S. Bank Trust National Association, as Trustee of the Tiki Series III Trust, dated September 28, 2018, and recorded at said Deeds in Book 50428, Page 120; by an assignment of mortgage from U.S. Bank Trust National Association, as Trustee of the Tiki Series III Trust to U.S. Bank Trust National Association, not in its individual capacity but solely as Owner Trustee for RCF 2 Acquisition Trust, dated June 26, 2025, and recorded at said Deeds in Book 60148, Page 3. For breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 12:00 P.M. on the 13th day of August 2026, at 178 Concord Street, Brockton, MA 02302, all and singular the premises described in said mortgage,
To wit:
The land with the buildings thereon situated in Brockton, Plymouth County, Massachusetts situated on the easterly side of Concord Street, bounded and described as follows:
Beginning at a stake in the easterly side of said Concord Street, said stake being seventy-one and 6/10 (71.6) feet southerly from the southeast corner of Hillside Avenue and said Concord Street; thence southerly, by said Concord Street, seventy-one and 6/10 (71.6) feet to a stake at land now or formerly of Allie V. Packard; thence easterly, by said land of said Packard, one hundred nineteen (119) feet, more or less, to a stone wall; thence northerly by said stone wall, seventy-one 6/10 (71.6) feet, more or less, to other land of said Packard; and thence westerly by land of said Packard, one hundred and nineteen (119) feet, more or less, to the stake at the point of beginning.
Said premises are conveyed subject to and together with the benefit of easements, restrictions and agreements of record, in any, insofar as the same are now in force and effect.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of ten thousand dollars ($10,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by wire transfer to Demerle & Associates P.C., 10 City Square, 4th Floor, Boston, MA 02129 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
