NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Mortgage given by PALMER RIVER DEVELOPMENT CO., LLC to J.I.F INVESTMENT CO., INC. dated December 7, 2012 and recorded with the Bristol (North) County Registry of Deeds (the "Registry") in Book 20669 at Page 202, of which mortgage the undersigned is the present holder, for breach of the conditions of said Mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11 o'clock A.M. on the 6th day of March, 2026 at 231 Perryville Road, Rehoboth, Massachusetts, all and singular the premises described in said mortgage,
To wit:
All that certain Lot or parcel of land, with the buildings and improvements thereon, located on the westerly side of Perryville Road in Rehoboth, Bristol County, Massachusetts being bounded and described as follows:
BEING laid out and designated as Lot No. 2 (two) on that certain plan of land entitled: "Land Owned by James E. Harney et ux in Rehoboth, Massachusetts E. Otis Dyer, Surv'r Rehoboth, Massachusetts Scale 1"=80' May 3, 1972, which said plan is recorded in the Bristol County North District in Plat Book 131 at Page 8.
Excepting therefrom the property described in that certain Partial Release of Mortgage, dated August 25, 2015, recorded in the Bristol County North Registry of Deeds in Book 22507, Page 235.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of ten thousand dollars ($10,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at the offices of Clavell & Associates, P.C., 355 Union Street, New Bedford, MA 02740 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
