ORDINANCE NO. 25-CODE-975
AN ORDINANCE AMENDING CHAPTER 8-3 OF THE BOROUGH CODE REGARDING CANNABIS LICENSING
WHEREAS, the Borough of Oakland had previously adopted certain ordinances related to cannabis businesses in the Borough; and
WHEREAS, the desires Borough amends this ordinance to correct an ambiguity in the code
NOW THEREFORE BE IT ORDAINED, by the Mayor and Borough Council of Oakland as follows:
Section I. Chapter 8, Section 3 of the Borough of Oakland Code under "Cannabis License Required" is amended as follows:
§ 8-3.6. Unlicensed operation prohibited; penalties.
a. Prohibition. No person, firm, corporation, or other entity shall operate, conduct, advertise, or open to the public any cannabis business in the Borough without first obtaining a valid Borough cannabis license issued pursuant to § 8-3 and, where applicable, a valid State license under the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act.
b. Penalty. Notwithstanding § 1-5 of this Code, any person, firm, corporation, or other entity that violates subsection (a) shall, upon conviction in the Municipal Court, be subject to a fine of $2,000 for each day the violation exists. Each day that an unlicensed operation continues shall constitute a separate and distinct offense.
c. Cumulative remedies. The penalties provided herein are in addition to, and not in lieu of, any other remedies or enforcement actions available under this chapter, Chapter 59 (Land Use and Zoning), or applicable State law.
Section II. All other parts, portions and provisions of Chapter 59 of the Borough of Oakland Code be and the same are hereby ratified and confirmed, except where inconsistent with the terms hereof. In the event of any such inconsistency, the terms of this Ordinance shall be deemed to govern.
Section III. The terms of this Ordinance are hereby declared to be severable; should any part, portion or provision hereof be declared invalid or unconstitutional, said finding shall not affect any other part, portion or provision thereof.
Section IV. This Ordinance shall take effect immediately upon final passage and publication according to law.
NOTICE:
The above ordinance was introduced at a meeting of the Mayor and Borough Council held on September 30, 2025. Adoption of this ordinance will be considered at a meeting to be held at the Municipal Court/Council Chambers 10 Lawlor Drive, Oakland, N.J. on October 14, 2025 commencing at 7:00 p.m., at which time and place all persons interested therein or affected thereby will be given an opportunity to be heard concerning same. Copies of this ordinance are available at the Municipal Building up to the time of the public hearing for members of the public who request the same.
