NOTICE OF
CHANGE ORDER IN EXCESS OF 20 PERCENT
FOR SANITARY SEWER PHASE 2 PROJECT
A contract was awarded by the Town of Newton to Montana Contracting Corp, Inc. in the amount of $595,000.00 by the adoption of Resolution #313-2024 on December 20, 2024 for the Sanitary Sewer Phase 2 Project.
Change Order #1 was accepted without resolution as there was no increase or adjustment to price. Change Order #2 was awarded by Resolution #230-2025 on October 27, 2025 to increase the project total in an amount not to exceed $95,000.00.
Town’s Engineers have advised that Change Order #3, in the amount of $78,212.28 is necessary in order to address critical matters in order to ensure the successful completion of the Project, more specifically to address the unforeseen circumstance which occurred during the construction of the sewer, resulting in the discovery of regulated soil resulting in a total construction price of $768,212.28, exceeding the original contract by 29.11%. Montana Contracting Corp., Inc has submitted a certification in support of the change of work order due to the unforeseen circumstances in the discovery of regulated soil.
The Newton Town Council adopted Resolution 281-2025 on December 15, 2025, and this advertisement in made in compliance with N.J.A.C. 5:30-11.9(c), since the new contract total exceeds 20 percent of the original contract total.
