PLEASE TAKE NOTICE that SMITH MEADOW ESTATES, LLC (the "Applicant") has applied to the Town of Newton for a minor subdivision and bulk variances to divide an existing lot with two residences into two separate lots, each with one residence. The Property is known as Lot 9, Block 24.02, commonly known as 16 and 18 Smith Street. The property is in the T-3 Zone District and the requested minor subdivision would require the following variance relief:
Driveway/Minimum Width: The existing driveway is 24.7' and is currently shared between the two residences. The Applicant is proposing two separate driveways, one would be 10' wide to serve 16 Smith Road (proposed Lot 9), and one driveway would be 11.6' wide to serve 18 Smith Road (proposed Lot 9.01).Driveway/Maximum Area: The proposed driveway serving 16 Smith Road (proposed Lot 9) would equate to 58.6% of the area of the principal dwelling footprint, and the driveway serving 18 Smith Road (proposed Lot 9.01) would equate to 76.9% of the area of the principal dwelling footprint, where a maximum of 50% of the area of the principal dwelling footprint is permitted.Minimum Lot Area: The proposed lot area for 16 Smith Road (proposed Lot 9) will be 3,549 s.f., and the proposed lot area for 18 Smith Road (proposed Lot 9.01) will be 2,644 s.f., whereas 9,000 s.f. is required.Minimum Lot Width: The proposed lot width for 16 Smith Road (proposed Lot 9) will be 49.6', and the proposed lot width for 18 Smith Road (proposed Lot 9.01) will be 50', whereas 72' is required.Maximum Lot Coverage: The proposed lot coverage for 18 Smith Rd (Lot 9.01) will be 62%, whereas the maximum permitted lot coverage is 60%.Minimum Front Yard (Principal Building): The existing and proposed front yard setback to 16 Smith Road (proposed Lot 9) will be 14'; and the existing and proposed front yard setback to 18 Smith Road (proposed Lot 9.01) will be 18', whereas 35' is required. This is an existing non-conforming condition. No changes are proposed.Minimum Side Yard (Principal Building): The existing and proposed side yard setback to 18 Smith Road (proposed Lot 9.01) will be 9.1', whereas 12' is required. This is an existing non-conforming condition. No changes are proposed.Minimum Rear Yard (Principal Building): The existing and proposed rear yard setback to 16 Smith Road (proposed Lot 9) will be 7.3'; and the existing and proposed front yard setback to 18 Smith Road (proposed Lot 9.01) will be 5.2', whereas 30' is required. This is an existing non-conforming condition. No changes are proposed.
The applicant will also seek any additional variances and/or waivers which may be deemed necessary at the time of the hearing.
A public hearing will be held on February 18, 2026, at 7:00 PM at the Newton Municipal Building, Council Chambers, located at 39 Trinity Street, Newton, NJ 07860. All persons interested in said hearing may be heard at the above time and place. Maps and documents for which approval is sought at the hearing will be on file and available for public inspection at least (10) days prior to the hearing during normal business hours in the office of the Land Use Board Administrator.
