Resolution
FINAL RESOLUTION AUTHORIZING PUBLIC IMPROVEMENT AND LEVYING SPECIAL ASSESSMENTS AGAINST BENEFITED PROPERTY in the Town of Algoma, Winnebago County, WISCONSIN.
WHEREAS, the governing body of Town of Algoma Sanitary District #1 in Winnebago County, Wisconsin, received a signed Waiver of Special Assessment Notices and Hearings from the affected property owners waiving their right to hold a public hearing for the purpose of hearing all interested persons concerning the preliminary resolution and report concerning the water system public improvements consisting of water supply mains and appurtenances and preliminary assessments against benefited property;
NOW, THEREFORE, BE IT RESOLVED, the governing body of the Town of Algoma Sanitary District #1, Winnebago County, Wisconsin, determines as follows:
1. The report of the Engineer as modified, a copy of which is attached here-to and incorporated herein as if fully set forth herein, including the plans and specifications and assessments set forth therein, is adopted and approved.
2. The Town of Algoma Sanitary District #1 shall advertise for bids and supervise construction of the improvements in accordance with the report hereby adopted as modified.
3. Assessments shown on the report represent an exercise of the police power and have been determined on a reasonable basis and are hereby confirmed.
4. Assessments for all projects included in the report are hereby combined as a single assessment but any interested property owner may object to each assessment separately or all assessments jointly for any purpose.
5. Assessments may be paid in cash or in 20 annual installments of principal plus interest as provided below. All assessments will be collected in installments except assessments with respect to which the property owner shall within 30 days from the date of the installment assessment notice referred to in Section 7 below elect to pay the assessment in full as provided on such notice. The assessments shall bear interest at the rate of 4.5% per annum on the unpaid balance. The first installment shall include interest from January 1 through December 31, 2026. Each subsequent installment shall include one year’s interest on the unpaid balance of the assessment.
6. The due date of the special assessments shall be deferred in accordance with Section 66.0715(2) of the Statutes, so that the first installment of the assessments shall be payable with the taxes levied in 2026 for collection in 2027.
7. The District secretary shall publish this resolution as a Class 1 Notice under Chapter 985, of the Statutes, in the assessment district and mail a copy of this resolution and a statement of the final assessment against the benefited property together with notice of installment payment privileges to every property owner whose name appears on the assessment roll whose post office address is known or can with reasonable diligence be ascertained.

INSTALLMENT ASSESSMENT NOTICE
Notice is hereby given that a contract has been (or is about to be) let for the proposed sanitary sewer and water system in the Town of Algoma Sanitary District #1, Winnebago County, Wisconsin, and that the amount of the special assessment therefore has been determined as to each parcel of real estate affected thereby and a statement of the same is on file with the District secretary and that it is proposed to collect the same in 20 equal annual installments of principal, as provided for by Section 66.0715(3) of the Wisconsin Statutes, with interest thereon at 4.5% per year; that all assessments will be collected in installments as above provided except such assessments on property where the owner of the same shall file with the District secretary within 30 days from date of this notice a written notice that the owner elects to pay in full the special assessment on the owner's property, describing the same, to the District secretary on or before November 1, 2026 unless the election is revoked. If, after making such election, said property owner fails to make the payment to the District secretary, the District secretary shall place the entire assessment on the next succeeding property tax roll. Partial payments in cash received on or before, November 1, 2026, will be applied to principal and future installments reduced pro rata.
