ORDINANCE NO. 26-299
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF LITCHFIELD PARK, MARICOPA COUNTY, ARIZONA, DECLARING THE FOLLOWING DOCUMENT A PUBLIC RECORD: CIVIL PENALTIES - SECTION 8, VIOLATIONS, AND PARKING REQUIREMENTS – SECTION 27C, CITY CENTER, AND SCREENING OF NON-PRINCIPAL STRUCTURES – SECTION 31, GENERAL PROVISION; AMENDING THE ZONING CODE OF THE CITY OF LITCHFIELD PARK, ARIZONA, SECTION 8, VIOLATIONS, SECTION 27C, CITY CENTER, AND SECTION 31, GENERAL PROVISIONS; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY; PROVIDING FOR PENALTIES; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Litchfield Park, Arizona (the "City") regulates the allowable land uses within the corporate limits of the City; and,
WHEREAS, the use of the City of Avondale court has necessitated an update of the violation language; the continued development of Litchfield Square requires a redirection of parking solutions; and, the use of non-living vegetation has not been effective, the City Council desires to update its Zoning Code to coincide with such changes and updates.
NOW THEREFORE, BE IT ORDAINED by the Council of the City of Litchfield Park, Arizona, as follows:
Section I. Declaration of Public Record.
That certain documents entitled "2026 Spring Updates" attached hereto as Exhibit "A," three copies of which are to remain on file in the office of the City Clerk, is hereby declared to be a public record and said copies are to remain on file with the City Clerk.
Section II. In General.
The Zoning Code of the City of Litchfield Park, Arizona, Section 8, Violations, Section 27C, City Center, Section 31, General Provisions, are hereby amended by repealing and replacing Section 31, General Provisions, with the attached Exhibit "A," Section 8, Violations, Section 27C, City Center, Section 31, General Provisions.
Section III. Providing for Repeal of Conflicting Ordinances.
All ordinances and parts of ordinances in conflict with the provisions of this Ordinance or any part of the Code adopted herein by reference are hereby repealed.
Section IV. Providing for Severability.
If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
Section V. Providing for Penalties.
The procedures and penalties set forth in Section 8, Violations, Enforcement and Penalties of the Litchfield Park Zoning Code, for violations of the Zoning Code, a zoning ordinance, a use permit, a variance or a design review approval shall apply to violations of this Ordinance. A violation of this Ordinance shall constitute a public nuisance. In addition to issuance of a civil citation or criminal citation pursuant to Section 8 of the Zoning Code, the code enforcement officer is authorized to abate the nuisance and charge the cost to the property owner following the procedures set forth in Article 9-5 of the City Code.
Section VI. Effective Date.
This Ordinance shall be effective from 30 days after the date written below.
