RESOLUTION NO. 12537 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MESA, ARIZONA, DESIGNATING THE GENERAL ELECTION DATE AND PURPOSES OF THE GENERAL ELECTION; PROVIDING FOR THE ISSUANCE OF A PUBLICITY PAMPHLET; PROVIDING THE DEADLINE FOR FILING ARGUMENTS FOR AND AGAINST BALLOT MEASURES; PROVIDING THE DEADLINE FOR VOTER REGISTRATION; PROVIDING THE TIMES FOR EARLY VOTING AND THE OPENING OF POLLS ON ELECTION DAY; AUTHORIZING ELECTION EXPENDITURES; PROVIDING FOR THE CANVASSING OF ELECTION RESULTS; AND AUTHORIZING THE CITY CLERK TO TAKE ALL NECESSARY ACTION TO FACILITATE THE ELECTION. Whereas, pursuant to Resolution No. 12473, the City of Mesa (the "City") called a primary election for July 21, 2026 (the "Primary Election"), for the nomination of candidates for the office of Councilmember in Council Districts 4, 5, and 6. Whereas, pursuant to Mesa City Charter Section 201 (F), a general election shall be held for those seats where a candidate does not receive a majority of all the valid ballots cast during the primary election· for such seat. Whereas, the City Council believes several issues of importance in the operation of the City should be submitted to the voters for their approval at the general election on November 3, 2026 (the "General Election"). Whereas, Resolution No. 12538 submits to the qualified electors of the City at the General Election two questions of authorizing the issuance and sale of general obligation bonds of the City for the purpose of funding projects intended to (1) Enhance Public Safety, and (2) Enhance Transportation Improvements for Safer and Less Congested Streets; and further designating the manner in which the election is conducted, the translation of election materials, voter registration deadlines, and early voting dates. Whereas, Ordinance No. 6017 submits to the qualified electors of the City at the General Election the question of amending Mesa City Charter Section 209(A). Whereas, Ordinance No. 6016 submits to the qualitied electors of the City at the General Election the question of amending Mesa City Charter Section 211. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MESA: Section 1. General Election. That November 3, 2026, has been set as the date for holding the General Election in the City for the purpose of electing a Councilmember in each of Council Districts 4, 5, and 6, where no candidate was elected at the Primary Election, and to submit to the voters the proposed ballot measures as set forth in Section 2. Section 2. Ballot Measures. At the General Election, the qualified electors of the City will be asked to vote on the following ballot measures: Question 1. General Obligation Bonds: Enhance Public Safety. Issue and sell general obligation bonds of the City to support fire and medical, police, and public safety improvements, facilities, and communication systems, associated equipment, apparatuses, and technology, municipal improvements that support community and public safety, and acquisition of land for such purposes. Question 2. General Obligation Bonds: Enhance Transportation Improvements for Safer and Less Congested Streets. Issue and sell general obligation bonds of the City to support safer and less congested streets, including for arterial street improvements, pavement reconstruction, street improvements, streetlights, traffic signals, communication infrastructure, shared use paths, associated improvements, and the acquisition of land for such purposes. Question 3. Charter Amendment: Section 209(A). To conform with state law, amend Mesa City Charter Section 209(A) relating to Council meetings to require that the procedures for fixing the time and place of regular meetings and giving public notice of meetings, and the purposes for executive sessions be in accordance with state law. Question 4. Charter Amendment: Section 211. To conform with state law modernization efforts, amend Mesa City Charter Section 211 relating to ordinances to require ordinances to be posted on the City's website, posted at one physical location in Mesa, and published in accordance with state law. Qualified electors of the City may also be asked to vote on any additional propositions or questions that legally qualify for the ballot. Section 3. Publicity Pamphlet. A publicity pamphlet will be mailed to each household within the City that contains a registered voter by the earliest date for receipt of a requested early ballot for the General Election. If the pamphlet is not mailed by such date, the City Clerk will provide a notice for when the pamphlet will be mailed and accessed or viewed. The pamphlet will contain the ballot measures as they will appear on the ballot along with the arguments supporting or opposing the measure. Arguments will be placed in the order in which they are filed with the City Clerk. Materials will be translated into Spanish as required by the Voting Rights Act of 1965. Section 4. Arguments For and Against. Arguments supporting or opposing the City's ballot measures must be filed with the Mesa City Clerk's Office, 20 East Main Street, Suite 150, by 6:00 p.m. on Wednesday, August 5, 2026. Arguments must include a sworn statement from the person sponsoring the argument, two executive officers for an organization, or the chairman and treasurer for a political action committee. Each argument must be submitted in an electronic format to the City Clerk and be accompanied by a deposit to offset the proportional costs of printing. This payment requirement will not be waived. Section 5. General Election Laws and Rules; Voter Registration. The General Election will be held, conducted, and canvassed in conformity with the general election laws of the State of Arizona, except as otherwise provided by law and a voter in the General Election must be a qualified elector of the City (as defined under state law and Mesa City Code Title 1, Chapter 8, Section 1). Maricopa County registration and voting lists will be used for the General Election. To be qualified to vote in the General Election, a City resident must be registered to vote by midnight on Monday, October 5, 2026. Section 6. Polling Places. Polling places will be open from 6:00 a.m. until 7:00 p.m. on Tuesday, November 3, 2026, and absentee and early voting will be permitted in accordance with the provisions of Arizona Revised Statutes Title 16, Chapter 4, Article 8. Section 7. Expenditures. All expenditures as may be necessary to order, notice, hold, and administer the General Election are hereby authorized, which expenditures will be paid from the current operating funds of the City. Section 8: Canvassing of Results. The official returns from the General Election will be made to the Mayor and Council of the City within twenty (20) days from the date of the General Election and the General Election will be canvassed and the results certified by the Mayor and Council of the City at a meeting to be held within twenty (20) days after the date of the General Election, as provided by law. Section 9. City Clerk Authorization. The City Clerk is hereby authorized to take all necessary action to facilitate the General Election. CONSIDERANDO que, de conformidad con la Resolución No. 12473, la Ciudad de Mesa —la “Ciudad”— convocó una elección primaria para el 21 de julio de 2026 —la “Elección Primaria”— para la nominación de candidatos al cargo de Concejal en los Distritos 4, 5 y 6 del Concejo Municipal. CONSIDERANDO que, de conformidad con la Sección 201(F) de la Carta Orgánica de la Ciudad de Mesa, se celebrará una elección general para aquellos cargos en los que ningún candidato reciba la mayoría de todos los votos válidos emitidos durante la elección primaria para dicho cargo. CONSIDERANDO que el Concejo Municipal considera que varios asuntos de importancia para el funcionamiento de la Ciudad deben someterse a la aprobación de los votantes en la elección general del 3 de noviembre de 2026 —la “Elección General”. CONSIDERANDO que la Resolución Núm. 12538 somete a los electores calificados de la Ciudad, en la Elección General, dos preguntas relativas a la autorización para la emisión y venta de bonos de obligación general de la Ciudad, con el propósito de financiar proyectos destinados a (1) Mejorar la seguridad pública; y (2) Mejorar las obras de transporte para calles más seguras y menos congestionadas; y además designa la manera en que se llevará a cabo la elección, la traducción de materiales electorales, las fechas límite de registro de votantes y las fechas de votación anticipada. CONSIDERANDO que la Ordenanza Núm. 6017 somete a los electores calificados de la Ciudad, en la Elección General, la pregunta de enmendar la Sección 209(A) de la Carta Orgánica de la Ciudad de Mesa. CONSIDERANDO que la Ordenanza Núm. 6016 somete a los electores calificados de la Ciudad, en la Elección General, la pregunta de enmendar la Sección 211 de la Carta Orgánica de la Ciudad de Mesa. POR LO TANTO, EL CONCEJO MUNICIPAL DE LA CIUDAD DE MESA RESUELVE LO SIGUIENTE: Sección 1. Elección General. Se establece el 3 de noviembre de 2026 como la fecha para celebrar la Elección General en la Ciudad, con el propósito de elegir a un Concejal en cada uno de los Distritos 4, 5 y 6 del Concejo Municipal, en aquellos casos en los que ningún candidato haya sido electo en la Elección Primaria, y para someter a los votantes las medidas electorales propuestas según se establece en la Sección 2. Sección 2. Medidas Electorales. En la Elección General, se solicitará a los electores calificados de la Ciudad que voten sobre las siguientes medidas electorales: Pregunta 1. Bonos de Obligación General: Mejorar la Seguridad Pública. Emitir y vender bonos de obligación general de la Ciudad para apoyar mejoras, instalaciones y sistemas de comunicación relacionados con bomberos y servicios médicos, policía y seguridad pública, así como equipos, aparatos y tecnología asociados, mejoras municipales que apoyen la seguridad comunitaria y pública, y la adquisición de terrenos para dichos fines. Pregunta 2. Bonos de Obligación General: Mejorar las Obras de Transporte para Calles Más Seguras y Menos Congestionadas. Emitir y vender bonos de obligación general de la Ciudad para apoyar calles más seguras y menos congestionadas, incluyendo mejoras en calles arteriales, reconstrucción de pavimento, mejoras viales, alumbrado público, semáforos, infraestructura de comunicación, senderos de uso compartido, mejoras asociadas y la adquisición de terrenos para dichos fines. Pregunta 3. Enmienda a la Carta Orgánica: Sección 209(A). Para ajustarse a la legislación estatal, enmendar la Sección 209(A) de la Carta Orgánica de la Ciudad de Mesa, relacionada con las reuniones del Concejo Municipal, a fin de requerir que los procedimientos para fijar la hora y el lugar de las reuniones ordinarias, otorgar aviso público de las reuniones y establecer los propósitos de las sesiones ejecutivas se realicen de conformidad con la ley estatal. Pregunta 4. Enmienda a la Carta Orgánica: Sección 211. Para ajustarse a los esfuerzos de modernización de la legislación estatal, enmendar la Sección 211 de la Carta Orgánica de la Ciudad de Mesa, relacionada con las ordenanzas, a fin de requerir que las ordenanzas se publiquen en el sitio web de la Ciudad, se publiquen en un lugar físico dentro de Mesa y se publiquen de conformidad con la ley estatal. También se podrá solicitar a los electores calificados de la ciudad que voten sobre cualquier otra propuesta o cuestión que cumpla con los requisitos legales para aparecer en la boleta electoral. Sección 3. Folleto Informativo. El folleto informativo se enviará por correo a cada hogar de la ciudad que cuente con un votante registrado, antes de la fecha límite para la recepción de la solicitud de voto anticipado para las Elecciones Generales. Si el folleto no se envía por correo antes de dicha fecha, la Secretaría Municipal deberá notificar cuándo se enviará y estará disponible para su consulta o visualización. El folleto deberá contener las propuestas de votación tal como aparecerán en la boleta, junto con los argumentos a favor o en contra de cada medida. Los argumentos se presentarán en el orden en que se entreguen a la Secretaría Municipal. Los materiales deberán traducirse al español según lo exige la Ley de Derechos Electorales de 1965. Sección 4. Argumentos a Favor y en Contra. Los argumentos a favor o en contra de las propuestas electorales de la ciudad deben presentarse en la Secretaría Municipal de Mesa, ubicada en 20 East Main Street, Suite 150, a más tardar a las 6:00 p. m. del miércoles 5 de agosto de 2026. Los argumentos deben incluir una declaración jurada de la(s) persona(s) que los presentan, de dos directivos de una organización o del presidente y el tesorero de un comité de acción política. Cada argumento deberá presentarse en formato electrónico ante la Secretaría Municipal e ir acompañado de un depósito para compensar los costos proporcionales de impresión. Este requisito de pago no podrá ser eximido. Sección 5. Leyes y Normas de la Elección General; Registro de Votantes. Las Elecciones Generales se celebrarán, llevarán a cabo y escrutarán de conformidad con las leyes electorales generales del Estado de Arizona, salvo que la ley disponga lo contrario, y un votante en las Elecciones Generales debe ser un elector calificado de la Ciudad (según se define en la ley estatal y en el Título 1, Capítulo 8, Sección 1 del Código de la Ciudad de Mesa). Las listas de registro y de votantes del condado de Maricopa se utilizarán para las Elecciones Generales. Para poder votar en las Elecciones Generales, los residentes de la ciudad deben estar registrados para votar antes de la medianoche del lunes 5 de octubre de 2026. Sección 6. Centros de Votación. Los centros de votación estarán abiertos desde las 6:00 a. m. hasta las 7:00 p. m. del 3 de noviembre de 2026, y se permitirá el voto anticipado y por correo de conformidad con las disposiciones del Título 16, Capítulo 4, Artículo 8 de los Estatutos Revisados de Arizona. Sección 7. Gastos. Por la presente se autorizan todos los gastos que sean necesarios para convocar, notificar, celebrar y administrar las Elecciones Generales, los cuales se pagarán con los fondos operativos corrientes de la Ciudad. Sección 8. Escrutinio Oficial de Resultados. Los resultados oficiales de las Elecciones Generales se entregarán al Alcalde y al Concejo de la Ciudad dentro de los veinte (20) días siguientes a la fecha de las Elecciones Generales y las Elecciones Generales serán escrutadas y los resultados certificados por el Alcalde y el Concejo de la Ciudad en una reunión que se celebrará dentro de los veinte (20) días siguientes a la fecha de las Elecciones Generales, según lo dispuesto por la ley. Sección 9. Autorización de la Secretaria Municipal. Por la presente, se autoriza a la Secretaría Municipal a tomar todas las medidas necesarias para facilitar las Elecciones Generales.
