NOTICE OF SALE
Pursuant to the ORDER CONFIRMING REFEREE REPORT AND JUDGMENT OF FORECLOSURE AND SALE entered in the Dutchess County Clerk's Office on February 2, 2026, I the undersigned, the Referee named in said Judgment, will sell at public auction at the Dutchess County Courthouse, 10 Market Street, Poughkeepsie, NY 12603 on March 13, 2026 at 2:30 p.m., the premises directed by said Judgment to be sold, which are described in Schedule attached hereto. All that certain piece or parcel of land situate in the Town of Poughkeepsie, County of Dutchess and State of New York, bounded and described as follows:
BEGINNING at a point on the southerly line of the parcel now or formerly owned by Albert W. Mack and Emma S. Mack, being the northeasterly corner of the herein described parcel and being 175.00 feet westerly from the northwesterly corner of the parcel conveyed by Lafayette Haines to Edson D. Sparks by deed dated August 27, 1958, and recorded in the office of the Dutchess County Clerk on September 9, 1958, Liber 978 of Deeds at Page 192; thence southwesterly, through land of Lafayette Haines, parallel with the westerly line of said parcel conveyed to Sparks, S 5° 42' 00" W, about 155 feet to a point on the northerly shore of Wappinger Creek, being the southeasterly corner of the herein described parcel; thence southwesterly, along the northerly and northwesterly shore of Wappinger Creek, about 62 feet to a point, being the northeasterly corner of the parcel conveyed by Lafayette Haines to Walter James Finger and Carol Florence Finger by Deed dated May 24, 1961 and recorded in the Office of the Dutchess County Clerk on May 24, 1961, in Liber 1058 of Deeds at Page 261; thence northwesterly along said parcel conveyed to Finger, N 9° 37' 30" W, 80.87 feet and N 73° 57' 30" W, 59.15 feet to a point on the easterly line of the parcel conveyed by Lafayette Haines and Evelyn E. Haines to Alice O. Lafko by deed dated March 16, 1953, and recorded in the Office of the Dutchess County Clerk on March 16, 1953, in Liber 883 of Deeds at Page 323, being the southwesterly corner of the herein described parcel; thence northeasterly, along said parcel conveyed to Lafko, N 24° 21' 30" W, E, 133.89 feet to the aforesaid parcel conveyed or to be conveyed to Mack, being the northwesterly corner of the herein described parcel; thence southeasterly, along said parcel, S 67° 06' 50" E, 14.90 feet and S 77° 26' 5-" E 49.56 feet to the point of beginning.
TOGETHER with a right of way over lands described in Deed dated December 22, 1955, and recorded in the Office of the Dutchess County Clerk on December 22, 1955, in Liber 907 of Deeds at Page 195.

BEGINNING at a point on the southerly line of the parcel now or formerly owned by Albert W. Mack and Emma S. Mack, being the northeasterly corner of the herein described parcel and being the northwesterly corner of the parcel conveyed by Lafayette Haines to Edson D. Sparks by Deed dated August 27, 1958, and recorded in the Office of the Dutchess County Clerk on September 9, 1958, in Liber 978 of Deeds at Page 192; thence southwesterly along the westerly line of said parcel conveyed to Sparks, S 5° 421" 00" W, about 135 feet to a point on the northerly shore of Wappinger Creek, being the *southwesterly corner of said parcel conveyed to Sparks; thence westerly, along *southeasterly corner of the herein described parcel and the said northerly shore of Wappinger Creek, 175 feet to a point, being the southwesterly corner of the herein described parcel; thence northeasterly, through land of Lafayette Haines, parallel with the aforesaid westerly line of the parcel conveyed to Haines, N 5° 42' 00" E, about 155 feet to a point on the aforesaid southerly line of the parcel conveyed or to be conveyed to Mack; thence southeasterly, along said parcel, S 77° 26' 50" E, 175.00 feet to the point of beginning.
SUBJECT, however, to the rights of others to use the ravine along the easterly line of the above described parcel to discharge surface waters to Wappinger Creek.
TOGETHER with right of way over the lands described in instrument dated December 22, 1955 and recorded in the Office of the Dutchess County Clerk on December 22, 1955, in Liber 907 of Deeds at Page 195.
SUBJECT, however, to the rights granted to any public utility company, LESS all that lot or piece or parcel of land conveyed by others to the County of Dutchess by Deed dated 11/08/62, and recorded in Liber 1193 cp. 114 on the 23rd day of November 1965 in the Dutchess County Clerk's Office, it is intended to describe tax parcel known as 14-6362-01-082517, Dutchess County, New York.
