RESOLUTION OF THE CHERRY BEACH ASSOCIATION
BOARD OF TRUSTEES
Presented and Adopted at a Special Meeting of the Board
Held on April 3, 2026
I, Secretary of the Cherry Beach Association, hereby certifiy that the following Resolution Regarding Short-Term Rentals and Protection of Association Property was adopted at a Special Meeting of the Board of Trustees of Cherry Beach Association held April 3, 2026:
WHEREAS, Cherry Beach Association ("Association") was created to manage and protect private park, beach, and recreational property reserved for the exclusive benefit of lot owners within Cherry Beach Littlefield's Subdivision;
WHEREAS, the original private beach and park deed restricts use of Association property to park, recreation, and bathing beach purposes for the exclusive benefit of lot owners and authorizes governance through reasonable rules and regulations adopted by the owners;
WHEREAS, the Association Bylaws authorize the Board of Trustees and the membership to adopt reasonable rules and regulations govening the use of Association property in order to preserve peace, order, safety, and the welfare of members;
WHEREAS, the Association has experiencd an incease in short-term rentals of homes within the subdivision, resulting in frequent use of Association property by tansient occupants who are not owners and who are unfamiliar with, or disregard, Association rules;
WHEREAS, the Board has received reports and observations of:
Over-occupancy of Short Term Rentals and excessive guest use of beach and park facilities contrary to exising rules;
Increased noise, parking congestion, and litter;
Repeated rule violations requiring disproportionate enforcement effort;
Dimished quiet enjoyment of Association property by lot owners and their families;
WHEREAS, short-term rental use is materially different from owner-occupied or long-term residential use in that it involves rotating, trnsiuent occupancy and functions in a manner similiar to lodging or resort use;
WHEREAS. the Board finds that such transient use is inconsistent with the historic residential character of Cherry Beach, the expectations of lot owners, and the limited private nature of Association property;
WHEREAS, Michigan law recognizes that private deed restrictions annd association rules may lawfully impose restrictions on property use that are more restrictive than municipal zoning ordinances;
NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees finds that short-term rentals pose a substantial and continuing risk to the proper use, mainteannce, safety, and enjoyment of Association property; and
BE IT FURTHER RESOLVED, that the Board recommends adoption of the attached Rule prohibiting short-term rentals with the subdivision, and submits the same to the membership for discussion and consideration at a duly called meeting of the Association.
