RULE REGARDING SHORT-TERM RENTALS
CHERRY BEACH ASSOCIATION

Section 1. Definitions.
"Short-Term Rentals". For purposes of this Rule, "Short-Term Rentals" means the rental, lease, licene, or occupancy of a dwelling or any portion therof for a period of less than thirty (30) consecutive days, whether or not consideration is paid, and whether arranged directly or through a third-party platform, agent, or service.
"Cherry Beach Littlefield Subdivision", means the Subdivision, situated in the Township of Cottrellville, St. Clair County Michigan, Lots 1 thru 64, including that portion reserved for private use, of parts of Private Claims 186 and 308, according to the Plat therof as recorded in Liber 13, Page 129 of Plats, St. Clair County Records.
"Cherry Beach" refers to the area within Cherry Beach Subdivision, contained within the grants found in the Vesting Deeds (Soyth Part and North Part) from John C. McDonald dated March 10, 1910 and recorded on March 39, 1910, in Liber (Volume) 185 of Deeds, Pages 426-7, St. Clair County Records.
Section 2. Prohibition. No dwelling located within Cherry Beach Littlefield's Subdivision shall be used, advertised, or held out for use as a Short-Term Rental.
Section 3. Permitted Use. Nothing in this rule shall prohibit:
a. Owner occupancy
b. Rental to a single household under a written lease of thirty (30) days or longer; or
c. Use by immediate family members or guests of the owner, provided no rent or similar consideration is paid for such use.
Section 4. Association Property Acccess. Ocu-cupants of a dwelling in violation of this Rule (who do not satisfy Section 3) shall have no right to, and shall not, use or access Association property, and such use shall constitute trespass.
Section 5. Enforcement. The Association may enforce this Rule by any lawful means, including:
a. Suspension of Association privigeges;
b. Monetary penalities as authorized by the Bylaws;
c. Injunctive relief;
d, Recovery of costs and reasonable attorney fees incurred in enforcement.
Section 6. Non-Preemption. This rule is independent of, and not superseded by, any Municipal ordiance permitting short-term rentals. Compliance with local Zoning or licensing requirements does not excuse violation of this Rule.
Section 7. Effective Date. This Rule shall apply prospectively and shall become effective May 21, 2026, following adoption by the Membership in accordance with the Associatio's governing documents.
