Under and by virtue of the Power of Sale contained in a Deed to Secure Debt and Security Agreement given by First Point Builders, LLC to Buford DeFord c/o The Bernson Group, LLC, dated December 9, 2024, filed December 12, 2024, and recorded at Deed Book 3547, Page 566, Chatham County, GA records, as re-recorded at Deed Book 3553, Page 613, Chatham County, GA records, as last assigned to The Bernson Group, LLC, by assignment, conveying the after-described property to secure a Promissory Note in the original principal amount of Seven Hundred Fifty Thousand AND 00/100 Dollars ($750,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the Courthouse door of CHATHAM COUNTY, Georgia, within the legal hours of sale on the first Tuesday in November, 2025, the following described Property:
ALL THAT CERTAIN LOT, TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN CHATHAM COUNTY, GEORGIA, AND BEING KNOWN AS LOT 45-A, WARD 4, SAVANNAH BEACH, SAID LOT MORE FULLY SHOWN UPON THAT CERTAIN MAP OR PLAT RECORDED IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF CHATHAM COUNTY, GEORGIA IN MAP BOOK 54, PAGE 292; SAID MAP OR PLAT IS INCORPORATED HEREIN AND MADE A PART HEREOF BY SPECIFIC REFERENCE.
Said property is known as 0 2nd Avenue, Tybee Island, GA 31328(Tax Parcel Identification Number 40007-18018), together with all fixtures and personal property attached to and constituting a part of said property, if any.
The debt secured by said Deed to Secure Debt and Security Agreement has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Promissory Note and Deed to Secure Debt and Security Agreement. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale as provided in said Deed to Secure Debt and Security Agreement and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt and Security Agreement first set out above.

To the best knowledge and belief of the undersigned, the party in possession of the property is First Point Builders, LLC, or a tenant or tenants.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
