NOTICE OF SALE UNDER POWER
Because of default in the payment of the indebtedness secured by the security deed executed by J. Ogeechee BP, LLC to ServisFirst Bank on June 11, 2025, and recorded in Deed Book 3699, Page 185, Chatham County, Georgia Records, ServisFirst Bank, as lender, pursuant to the security deed and the secured note, has declared the entire amount of said indebtedness due and payable and, pursuant to the Power of Sale contained in the security deed, will on the first Tuesday in March, 2026 during the legal hours of sale, at the courthouse door in Chatham County, Georgia, sell at public outcry to the highest and best bidder for cash, the following described property:
ALL that certain lot, tract or parcel of land situate, lying and being in the 7th G.M. District of Chatham County, Georgia, and being shown and designated as Lot 3A-2 on that plat entitled "Elk on 17, Minor Subdivision Plat, Lots 3A-1, 3A-2, 3A-3, Being a Subdivision of the 7.127 Acre Lot 3-A of the Anderson Tract, known as 5636 Ogeechee Road and Located in the 7th G.M District, Chatham County, Georgia," prepared by George M. Ferreira, Georgia Registered Land Surveyor No. 2607, of MITR GPS/GIS/Survey, dated October 9, 2023, and recorded in Plat Book 54, Page 681, Chatham County, Georgia, records, said map being incorporated herein by reference and being made a part hereof for better determining the metes, bounds, courses, and distances of the subject property.
TOGETHER WITH appurtenant easement rights pursuant to that Declaration of Access, Utility, and Drainage Easement, dated June 11, 2025, and recorded in Deed Book 3697, Pages 358-365, Chatham County, Georgia, records.
To the best knowledge and belief of the lender, the party in possession of the property is J. Ogeechee BP, LLC or a tenant or tenants, and the property is more commonly known as 5652 OGEECHEE ROAD, SAVANNAH, GA 31405.
The property will be conveyed subject to (i) any unpaid property taxes which may be liens against the property; and (ii) all easements and restrictions of record, if any, having priority over the security deed. The sale will be held subject to (i) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (ii) final confirmation and audit of the status of the loan with the holder of the security deed.
This property is sold AS IS and WHERE IS and without representation or warranty, and without recourse against Lender.
The property will be sold as the property of J. Ogeechee BP, LLC and the proceeds of sale will be applied to the payment of all indebtedness secured by the security deed, the expense of sale, all as provided in the security deed, and lender will execute a deed to the purchaser as provided in the security deed.
