ALL THAT CERTAIN LOT OR PARCEL OF LAND, TOGETHER WITH THE BUILDINGS AND IMPROVEMENTS THEREON, SITUATE ON THE NORTH SIDE OF MADISON AVENUE, BETWEEN PLUM AND NECTORINE STREETS, IN THE TOWN OF CAPE CHARLES, NORTHAMPTON COUNTY, VIRGINIA, DESIGNATED BY THE LETTER "F" ON THAT CERTAIN MAP OR PLAT ENTITLED "A CORRECTED MAP OF THE SUBDIVISION OF THE LOTS 150, 151, 154, 155, 158 AND 159, CAPE CHARLES, VIRGINIA, MADE BY THE CAPE CHARLES REAL ESTATE CORPORATION, SEPTEMBER 14, 1911, INTO LOTS E, F, G, H, I, J, K AND L, AND INCLUDING SIX (6) FEET OF LOT 162 AS PER SURVEY", BY A.L. DETWILER, CIVIL ENGINEER, FEBRUARY 15, 1921, ATTACHED TO AND MADE A PART OF A DECREE ENTERED BY THE CIRCUIT COURT OF NORTHAMPTON COUNTY, VIRGINIA, ON THE 27TH DAY OF NOVEMBER 1922, IN THAT CERTAIN CHANCERY CAUSED AND TITLED "CAPE CHARLES REAL ESTATE CORPORATION, ET ALS, V. MARGARET SARAH JONES PARKS, ET ALS" OF RECORD IN CHANCERY ORDER BOOK 6, PAGE 437, AND SUBSEQUENTLY RECORDED IN DEED BOOK 79, AT PAGE 596, AND A COPY OF SAID PIX ATTACHED TO AND MADE A PART OF SAID DECREE, BEING RECORDED IN SAID CLERK'S OFFICE IN PLAT BOOK 3, PAGE 136, WHICH SAID DECREE REVISES AND CORRECTS THE ERRORS CONTAINED IN THAT CERTAIN DEED, DATED NOVEMBER 14, 1918 FROM CAPE CHARLES REAL ESTATE CORPORATION TO LOVEY NORMAN WRIGHT, IN RESPECT TO LOCATION AND BOUNDARY LINES OF THE AFORESAID LOT OR PARCEL OF LAND DESIGNATED BY THE "F" SEE DEED OF LOVEY NORMAN WRIGHT TO ANDREW ELSNER DATED NOVEMBER 22, 1919, AND RECORDED IN THE AFORESAID CLERK'S OFFICE IN DEED BOOK 76, PAGE 164; AND ALSO DEED OF PARTITION BETWEEN MARTIN A. ELSNER AND VERLEADER C. ELSNER DATED NOVEMBER 13, 1962, AND RECORDED IN THE AFORESAID CLERK'S OFFICE IN DEED BOOK 147, AT PAGE 527.
TERMS: CASH. A deposit of Ten percent (10%) of the sale price or Ten percent (10%) of the original principal balance of the subject deed of trust, whichever is lower, will be required of the successful bidder at time of sale. Prior to the sale, interested bidders will be required to register with and must present a bid deposit which may be held during the sale by the trustee. The bid deposit must be certified funds and/or cash, but no more than $9,900.00 of cash will be accepted. The successful bidder's deposit will be retained at the sale and applied to the sale price. If held by the trustee, all other bid deposits will be returned to the unsuccessful bidders. Settlement is to be made within 15 days. The successful bidder will be responsible for obtaining possession of the property, and for all costs and fees related to recording the Trustee's Deed, including the grantors tax. The successful bidder will be required to execute a Memorandum of Trustee's Sale, available for review upon request before the sale, outlining additional terms of sale and settlement. A Trustee's Deed will be prepared by Trustee's attorney at high bidder's expense.
