NOTICE OF PUBLIC HEARINGS
This is notice of a public hearing by the Indian River County Planning and Zoning Commission and a second public hearing by the Indian River County Board of County Commissioners to consider adoption of an ordinance; entitled:
AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, CONCERNING AMENDMENTS TO ITS LAND DEVELOPMENT REGULATIONS; PROVIDING FOR AMENDMENT TO CHAPTER 902, ADMINISTRATIVE MECHANISMS; BY AMENDING SECTION 902.06, RESERVED TO PROVIDE REASONABLE ACCOMODATION PROCEDURES INCLUDING PROCEDURES FOR REVIEW AND APPROVAL OF CERTIFIED RECOVERY RESIDENCES; AND BY PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; CODIFICATION; SEVERABILITY; AND EFFECTIVE DATE.
A vote will be taken on the proposed ordinance to consider approval of the ordinance to the Board of County Commissioners. If adopted, the ordinance will establish procedures for processing requests for reasonable accommodation to the County's ordinances, rules, policies, and procedures for persons with disabilities as provided by the Federal Fair Housing Amendments Act (42 U.S.C. 3601, et. seq.) ("FHAA") and Title II of the Americans with Disabilities Act (42 U.S.C. Section 12131, et. seq.) ("ADA"). These new procedures will also allow any licensed or certified residential provider (including any Certified Recovery Residence as defined in Section 397.311 (5), F.S.) to request reasonable accommodation.
A public hearing, at which parties in interest and citizens shall have an opportunity to be heard, will be held by the Planning and Zoning Commission of Indian River County, Florida, in the County Commission Chambers of the County Administration Building, located at 1801 27th Street, Vero Beach, Florida on Thursday, January 22, 2026, at 6:00 PM; and by the Board of County Commissioners of Indian River County, Florida, on Tuesday, February 10, 2026, at 9:00 AM.
A draft of the proposed ordinance is available at the Indian River County Planning Division office located in the Planning & Development Services Department on the first floor of the County Administration Complex Building "A". Anyone who may wish to appeal any decision, which may be made at this meeting will need to ensure that a verbatim record of the proceedings is made, which includes testimony and evidence upon which the appeal is based.
