NOTICE OF PUBLIC HEARING DEPARTMENT OF GAME, FISH AND PARKS
A Public Hearing will be held at the State Library Commons, 800 Governors Drive, Pierre, SD 57501 at 2:00 pm on Thursday, March 5, 2026, to consider adoption, amendment and repeal of Administrative Rules of South Dakota numbered:
1. ARSD 41:04:02:40. Lawrence County public water safety zones.
Effect: Modify § 41:04:02:40 to restrict Iron Creek Lake in Lawrence County to a no wake zone.
Reason: The primary concerns aresafetyanduser conflict. The lake is too small to safely accommodate jet skis or large boats operating at speeds above no-wake.
2. ARSD 41:05:02:25. Grant County refuges.
Effect: Modify §41:05:02:25 to remove the Lake Albert State Waterfowl Refuge.
Reason: By removing the refuge status, landowner control over hunting access on their property will be restored.
3. ARSD 41:06:62:03. Number of licenses.
Effect: Modify ARSD 41:06:62:03 by removing the specific number and types of licenses available with no more than the maximum number of licenses authorized by the SDCL 41-6-84.
Reason: This change will generate additional revenue for wildlife habitat.
Persons interested in presenting amendments, data, opinions, and arguments for or against the proposed rules may appear in-person at the hearing, or mail or e-mail them to the office of the Secretary of the Department of Game, Fish, and Parks, Foss Building, 523 East Capitol, Pierre, South Dakota 57501, or by going to the GFP website at http://gfp.sd.gov/forms/positions. All persons who desire to submit written amendments, data, opinions, arguments, and their views by mail or email are encouraged to mail or transmit the same in sufficient time so that it is received by and in the office of the Secretary of the Department of Game, Fish, and Parks 72 hours prior to the date of the hearing. All written and email comments must include the name, hometown/city, and state of the person submitting the comments.
After the written comment period, the Game, Fish & Parks Commission will consider all written and oral comments it receives on the proposed rules. The Commission may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.
