NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Spartanburg.
REQUEST FOR RELEASE OF FUNDS
On or about April 27, 2026, the City of Spartanburg will authorize the Spartanburg Housing Authority to submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Housing Choice Voucher (HCV) and Project-Based Voucher (PBV) funds under Section 8 of the name of the Housing Act of 1937, as amended, to undertake a project known as Construction of 24(18-2BR & 6-1BR) units that will use 8(6-2BR & 2-1BR) project base vouchers.
FINDING OF NO SIGNIFICANT IMPACT
The City of Spartanburg has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional information is contained in the Environmental Review Record (ERR) on file at the City of Spartanburg, 295 E Main Street, Spartanburg SC 29302 between 8:00 a.m. and 5:00 p.m. weekdays, except City holidays.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the City of Spartanburg which is responsible for receiving and responding to comments. All comments received by April 24, 2026, will be considered by the City prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The City of Spartanburg is certifying to the U.S. Department of Housing and Urban Development (HUD) that Martin Livingston in his capacity as the Neighborhood Services Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relationship to environmental reviews, decision making, and action, and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Spartanburg Housing Authority to implement the projects located at: 530 Caulder Avenue, Spartanburg - South Carolina.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and City certification for a period of 15 days following the anticipated submission date (April 27, 2026) or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Spartanburg; (b) the City of Spartanburg has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the Bernard R. Dyal, Director, Office of Public Housing, U.S. Department of Housing and Urban Development, 1835 Assembly Street, 13th floor, Columbia, SC 29201. Potential objectors should contact HUD to verify the actual last day of the objection period.
