NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction, without warranty as to title, possession or encumbrances, to the highest bidder, payable in lawful money of the United States at the time of sale, at the front door of the Washington County Courthouse, St. George, Fifth District Court, 206 West Tabernacle St George, UT 84770, on May 19, 2026 at 1:30 P.M. of said day, for the purpose of foreclosing a lien for assessments under (i) Utah Code §§57-8-44-54 (condominium) or §§57-8a-301-311 (planned development), as the case may require (the "Law") and/or (ii) Declaration of Condominium of Fleetwood Square Condominiums (the "Declaration"), with a beneficial interest in the lien in favor of Fleetwood Square Homeowners Association, Inc., covering real property reputed to be owned, as of the date of the Notice of Default and Election to Sell, by Kimberli Jean Estepp, a Single Woman, and located at 1050 E 500 S St #35 , St. George, Utah 84790, and more particularly described as: LOT 35, CONTAINED WITHIN THE FLEEWOOD SQUARE CONDOMINIUMS AMENDED PLAT "C", A CONDOMINIUM PROJECT AS THE SAME AS IDENTIFIED IN THE RECORD OF SURVEY MAP RECORDED IN WASHINGTON COUNTY, (AS SAID RECORD-Of SURVEY MAP MAY HAVE HERETOFORE BEEN AMENDED OR SUPPLEMENTED) AND IN THE DECLARATION RECORDED ON MAY 09, 1985 IN WASHINGTON COUNTY, AS ENTRY NO. 275793 IN BOOK 376 AT PAGE 403 (AS SAID DECLARATION MAY HAVE HERETOFORE BEEN AMENDED OR SUPPLEMENTED). TOGETHER WITH THE APPURTENANT UNDIVIDED INTEREST IN SAID PROJECT'S COMMON AREAS AS ESTABLISHED IN SAID DECLARATION AND ALLOWING FOR PERIODIC ALTERATION BOTH IN THE MAGNITUDE OF SAID UNDIVIDED INTEREST AND IN THE COMPOSITION OF THE COMMON AREAS AND FACILITIES WHICH SAID INTEREST RELATES. Subject to easements, restrictions and rights of way appearing of record or enforceable in law and equity and general property taxes for the year 2021 and thereafter. PARCEL NUMBER: SG-FWS-C-35. A Homeowner Association Notice of Lien was recorded on April 21, 2025, as Document ID 20250013528, in the records of the Washington County Recorder. A Notice of Default and Election to Sell was recorded on October 09, 2025, as Document ID 20250034873, in the records of the Washington County Recorder. Said sale is for the purpose of paying obligations provided for under the Law and/or the Declaration, including fees, charges, and expenses of Trustee, advances, if any, paid under the terms of the Declaration, together with interest thereon; and the unpaid assessments, together with interest thereon as stated in the Declaration or By-law. Purchaser must be prepared to tender a $3,000.00 deposit in certified funds/cashier's check at time of sale made payable to Jenkins Bagley Sperry PLLC, Client Trust Account. Cash is not acceptable. The deposit is forfeited and treated as additional sale proceeds if the bidder refuses to pay the balance of the bid price within 24 hours of the sale. Notice to Tenant: If the stated purpose of the obligation for which the trust deed was given as security is to finance residential rental property and if you are a tenant, be advised, as stated in the accompanying Notice of Trustee's Sale, that this property is scheduled to be sold at public auction to the highest bidder unless the default in the obligation secured by this property is cured. If the property is sold, you may be allowed under federal law to continue to occupy your rental unit until your rental agreement expires, or until 90 days after the date you are served with a notice to vacate, whichever is later. If your rental or lease agreement expires after the 90-day period, you may need to provide a copy of your rental or lease agreement to the new owner to prove your right to remain on the property longer than 90 days after the sale of the property. You must continue to pay your rent and comply with other requirements of your rental or lease agreement or you will be subject to eviction for violating your rental or lease agreement. The new owner or the new owner's representative will probably contact you after the property is sold with directions about where to pay rent.
