NOTICE OF FINAL AGENCY ACTION BY THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION
Notice is given that the Florida Department of Environmental Protection's (DEP) Final Agency Action is approval of application number 0456151-001-EI/37 for Environmental Resource Permit Number 0456151-001-EI/37 to the Florida Department of Transportation for their project named State Road No. 263 (Capital Circle) from SR 61(Crawfordville Road) to CR 2203(Springhill Road) and which proposes to add lanes and reconstruct roadway on __88__ acres. The project is located in _ Leon _ County, Section(s) __22__, Township __1__ South, Range __1__ West. [BS1] The file(s) pertaining to the project referred to above is available for inspection Monday through Friday except for legal holidays, 8:00 a.m. to 5:00 p.m., at the DEP Northwest District, 160 W. Government Street, Suite 308 Pensacola, Florida 32502-5740
You or any person whose substantial interests are or may be affected by the DEP's intended or proposed action may request an administrative hearing on that action by filing a written petition in accordance with Sections 120.569 and 120.57, Florida Statutes (F.S.), Uniform Rules of Procedure Chapter 28-106, Florida Administrative Code (F.A.C.) and DEP Rule 62-110.106, F.A.C. Unless otherwise provided by law, a petition for administrative hearing must be filed with (received by) the District within 21 days of receipt of this newspaper published notice of agency action.
Pursuant to Subsection 373.427(2)(c), F.S., for notices of intended or proposed agency action on a consolidated application for an environmental resource permit and use of state-owned submerged lands concurrently reviewed by DEP, a petition for administrative hearing must be filed with (received by) DEP within 14 days of receipt of written notice.
Any person who receives written notice of an agency decision and who fails to file a written request for a hearing within 21 days of receipt or other period as required by law waives the right to request a hearing on such matters.
Mediation pursuant to Section 120.573, F.S., to settle an administrative dispute regarding DEP intended or proposed action is not available prior to the filing of a petition for hearing.
A petition for administrative hearing is deemed filed upon receipt of the complete petition by the DEP Agency Clerk in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at Agency_Clerk@FloridaDEP.gov. Also, a copy of the petition shall be mailed to the applicant at the address indicated above at the time of filing.
