THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
Default having been made in the payment of the debt secured by that certain mortgage executed by Elaine R Davis and William H Davis Jr., Mortgagor(s), to Mortgage Electronic Registration Systems, Inc., as nominee for First Federal Bank, Mortgagee, on December 8, 2008, said mortgage being recorded on December 29, 2008 in the Probate Office of Tuscaloosa County, Alabama in Book 2008, Page 92260, modified by Loan Modification recorded on September 10, 2015 in Book 2015, Page 51437, and later assigned to Carrington Mortgage Services, LLC , by reason of such default, having declared all the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, Carrington Mortgage Services, LLC will sell at public outcry, for cash, to the highest bidder, in front of the Courthouse door in the City of Tuscaloosa, Tuscaloosa County, Alabama during the legal hours of sale on April 17, 2026 the following described real estate situated in Tuscaloosa County, Alabama, to wit:
Tract I: A parcel of land located in the Northwest quarter of the Southwest quarter of Section 24, Township 22, South, Range 9 West, being more particularly described as follows: commencing at the Northwest corner of the Northwest quarter of the Southwest quarter of Section 24, Township 22 South, Range 9 West; thence South 85 degrees, 43 minutes, 00 seconds East, a distance of 25.53 feet to an iron pin the point of beginning; thence South 07 degrees, 28 minutes, 49 seconds West, a distance of 44.89 feet to an iron pin; thence South 59 degrees, 04 minutes, 51 seconds East, a distance of 124.89 feet to an iron pin; thence South 85 degrees 43 minutes, 00 seconds East, a distance of 171.00 feet to iron pin; thence North 01 degrees, 05 minutes, 34 seconds East, a distance of 100.97 feet to an iron pin on the North line of said quarter-quarter; thence North 85 degrees; 43 minutes, 00 seconds West a distance of 274.51 feet to the point of beginning.
Tract II: Access easements 60 feet access easement- A 60 foot easement lying in and running across part of the Northwest quarter of Section 24, Township 22 South, Range 9 West, Tuscaloosa County, Alabama, and being measured 30 feet from centerline; Commence at a 1 inch iron pipe found at the Northwest corner of the Northwest quarter of the Southwest quarter of Section 24; thence run South 85 degrees 43 minutes, 11 seconds East and along the North line of said quarter 330.41 feet to a inch capped rebar set; thence run South 1 degrees, 05 minutes, 34 seconds West 15.21 feet; thence run South 85 degrees, 45 minutes, 13 seconds East 306.67 feet to the point of beginning; thence run South 00 degrees, 04 minutes, 21 seconds East 482.92 feet; thence run South 05 degrees, 04 minutes, 02 seconds East 21.36 feet; thence run South 12 degrees, 14 minutes, 52 seconds East 16.24 feet; thence run South 22 degrees, 49 minutes, 27 seconds East 32.42 feet to the point of ending, and said point lying at the intersection of said centerline of easement and the centerline of Paul Duncan Road.
30 FOOT EASEMENT- A 30 foot access easement lying in and running across part of the Northwest quarter of the Southwest quarter of Section 24, Township 22, Range 9 West, Tuscaloosa County, Alabama and being measured 15 feet from centerline; Commence at a 1 inch iron pipe found at the Northwest corner of the Northwest quarter of the Southwest quarter of Section 24; thence run South 85 degrees, 43 minutes, 11 seconds East and along the North line of said quarter 300.41 feet to inch capped rebar set; thence run South 1 degrees, 05 minutes 34 seconds West 15.21 feet to the point of beginning; thence run South 85 degrees, 45 minutes, 13 seconds East 306.67 feet to the Point of Ending.
30 FOOT ACCESS EASEMENT- A 30 foot easement ingress or egress over and across a 30 foot strip of land lying 15 feet on either side of the following described center line; commencing at the Northwest corner of the Northwest quarter of the Southwest quarter of Section 24, Township 22 South, Range 9 West; thence South 85 degrees 43 minutes 00 seconds East, a distance of 330.19 feet to an iron pin; thence South 01 degrees 06 minutes 21 seconds West, a distance of 15.19 feet to the point of beginning of said center line; thence North 85 degrees 45 minutes 13 seconds West, a distance of 30.14 feet to the point of ending the centerline.
Tract III: EASEMENTS FOR SANITARY SEWER LINE AND ON SITE WATER DISPOSAL- An easement for Sanitary Sewer Lines and On-Site Water Disposal. Being more particularly described as follows: A strip of land 15 feet in width, 7.5 feet on either side of the following described centerline; Commencing at the Southeast corner of the property described in that certain deed recorded in Deed Book 2002, at Page 7511 in the Probate Office of Tuscaloosa County, Alabama; thence run North 85 degrees 43 minutes 11 seconds West for a distance of 65.60 feet to a point, being the point of beginning; thence run South 07 degrees 09 minutes 51 seconds East for a distance of 221.33 feet to the ending point of said centerline. This point also being the point of beginning of a 60 foot by 100 foot disposal area which is more particularly described as beginning at the ending point of centerline described above and thence run North 45 degrees 28 minutes 51 seconds East for a distance of 40.48 feet to a point; thence run South 44 degrees 31 minutes 00 seconds East for a distance of 100.00 feet to a point; thence run South 45 degrees 29 minutes 00 seconds West for a distance of 60.00 feet to a point; Thence run North 44 degrees 31 minutes 00 seconds West 100.00 feet to a point; thence run North 45 degrees 29 minutes 19 seconds East for a distance of 19.52 feet to the point of beginning; ALSO; a 15 foot easements for sanitary sewer lines lying 7.5 feet on either side of the following described centerline; Commencing at the Northwest corner of the Northwest quarter of Section 24, Township 22 South, Range 9 West; thence South 85 degrees 43 minutes 00 seconds East, a distance of 330.19 feet to an iron pin; thence South 01 degrees 06 minutes West, a distance of 212.97 feet to an iron pin; thence North 85 degrees 46 minutes 11 seconds West, a distance of 65.69 feet to the point of beginning of centerline; thence North 21 degrees 25 minutes 54 seconds West, a distance of 124.19 feet to the point of ending of the centerline.
The access easements and Sanitary Sewer line and on-site waste disposal easements described above are made appurtenant and are to run with the land first described above as Tract I. Said easements are expressly made subject to those certain restrictions and conditions as se t forth by instrument recorded in Deed Book 2006, Page 13965 in the Probate Office of Tuscaloosa County, Alabama, irregardless of whether or not the easements are correctly described.

THIS PROPERTY WILL BE SOLD ON AN “AS IS, WHERE IS” BASIS, WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO.
Said sale will be made subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the mortgage first set out above and restrictions of record in the Probate Office aforesaid, matters of survey, and to any Federal or State Tax liens, if any, and/or special assessments, if any, which might adversely affect the title to the premises.
Said sale will be made for the purpose of paying the indebtedness secured by the above described mortgage to Carrington Mortgage Services, LLC , Mortgagee, and the proceeds thereof will be applied as provided for in the terms of said mortgage.

The successful bidder must tender a non-refundable deposit of Five Thousand Dollars ($5,000.00) in certified funds made payable to McMichael Taylor Gray LLC at the time and place of the sale. The balance of the purchase price must be paid in certified funds by noon the next business day to McMichael Taylor Gray LLC at 3550 Engineering Drive, Suite 260, Peachtree Corners, GA 30092.
McMichael Taylor Gray, LLC reserves the right to award the bid to the next highest bidder should the highest bidder fail to timely tender the total amount due. The Mortgagee/Transferee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate. This sale is subject to postponement or cancellation.
