VILLAGE OF MAINE, MARATHON COUNTY, WISCONSIN
AN ORDINANCE CREATING SECTION 8.15 OF THE GENERAL CODE OF ORDINANCES ENTITLED VILLAGE BOARD MEETINGS AND RULES OF PROCEDURE
The Village Board of the Village of Maine, Marathon County, Wisconsin, do ordain as follows:
SECTION 1: Section 8.15 of the General Code of Ordinances of the Village of Maine, Marathon County, Wisconsin entitled Village Board Meetings and Rules of Procedure is hereby created as follows:
8.15 - Village Board Meetings and Rules of Procedure.
Sec. 8.15.010 - Meetings to be public; public notice.
Except as provided in Wis. Stat § 19.85, all meetings of the village board, committees and commissions thereof shall be open to the public and public notice given as required by Wis. Stat. § 19.84.
Sec. 8.15.020 - Quorum.
Three (3) village board members, including the village president shall constitute a quorum, but a lesser number may adjourn from time to time or compel the attendance of absent members. A call of the house may be ordered by a majority vote if three (3) trustees are present.
Sec. 8.15.030 – Village board meetings.
(a) Regular meetings. Regular meetings of the village board shall be held at the village hall or at any other place designated by the village board, on the second and fourth Monday of every month at 6:00 p.m. Any regular meeting falling on a legal holiday shall be held on a day designated by the village board and at the same hour and place. The village board may cancel any regular meeting.
(b) Special meetings. Special meetings of the village board may be called by the village president or two (2) trustees by written request to the village clerk. The village clerk shall immediately post notice of the meeting in accordance with Wis. Stat. §19.84 together with the agenda and no later than twenty-four (24) hours prior to said meeting notify each trustee by their village email of the time and purpose of such meeting.
(c) Budget Public Hearing. The village clerk shall post notice of the hearing in accordance with Wisconsin Statutes and notify each trustee by their village email of the date and time of said hearing no later than 7 days prior to the budget public hearing.
(d) Meeting Minutes.
(1) Pursuant to Wis. Stat. § 19.21(7) any taped recording of a meeting, as defined in Wis. Stat. §19.82 (2), may be destroyed no sooner than 90 days after the minutes have been approved and published if the purpose of the recording was to make minutes of the meeting.
(2) No later that the Thursday preceding the next regularly scheduled village board meeting, approved meeting minutes of the village board as well as any approved committee and commissions minutes shall be posted to the village website.
Sec. 8.15.040 - Agenda.
A request in writing or by email to the village president by a trustee by 12:00 p.m. the Monday preceding a Monday regular village board meeting may be made to the village president to add an agenda item to the immediately upcoming Monday regular village board meeting. The village president shall coordinate the preparation of the agenda. Any item that is properly submitted shall be placed on the next regularly scheduled village board meeting agenda. No substantive revisions, additions, or deletions to an agenda may occur after 5:00 p.m. on the Wednesday preceding the Monday regular village board meeting for which the agenda applies.
(a) All meeting material, including all supplemental documents pertaining to the agenda item to be considered by the village board at its regularly scheduled meeting shall be provided to each village trustee in electronic format as well as hand delivered to each village trustee's residence or delivered to each trustee's mailbox at the village hall no later than the Thursday prior to the Monday regular village board meeting for which the packet is intended. The meeting materials shall include the monthly check register long form in pdf as well as the budget to actual report.
(b) Meeting material packets, except unapproved meeting minutes, but including written reports, shall be posted on the Village of Maine website on the Thursday prior to the Monday regular board meeting subsequent to the village board meeting applicable to said materials, subject to all statutes, rules, ordinances, or board action concerning the same.
Sec. 8.15.050 - Order of business.
(a) The business of the village board shall be conducted in the following order unless specifically requested otherwise in writing by the village president or a village trustee.
(a) Silence cell phones.
(b) Call meeting to order.
(c) Roll call.
(d) Pledge of allegiance.
(e) Village President report.
(f) Finance and Personnel Committee report.
(g) Treasurer report.
(h) Fire Department report.
(i) County supervisor report.
(j) Public comment regarding Other Business items, limited to three minutes.*
(k) Other Business.
(l) New business.
(m) Next Board of Trustees' meeting date, time, and place.
(n) Adjournment.
* During the public comment period, the village trustees may receive information from the public and may discuss any matter raised by the public. If however, a member of the public raises a subject that does not appear on the meeting notice, the village trustees shall limit the discussion of that subject and to defer any extensive deliberation to a later meeting for which more specific notice may be given. In addition, the village board may not take formal action on a subject raised in the public comment period, unless that subject is also identified in the meeting notice.
Sec. 8.15.060 - Presiding Officer.
(a) Control of meeting. The village president shall preserve order and preside at the meetings of the village board. A member may appeal the decision of the presiding officer. Such appeal is not debatable and must be sustained by a majority of the members present, exclusive of the presiding officer.
(b) Absence of village president. If the village president is absent at any meeting, the village clerk shall call the meeting to order and preside until the village board selects a trustee to preside for that meeting.
Sec. 8.15.070 - Parliamentary Rules.
(a) Speaking before the village board. Every member, previous to his or her speaking, shall address the presiding officer and shall not be interrupted except by a call of order.
(b) Motions. When a motion is made and seconded, it shall be stated by the chair, or if in writing, shall be read by the village clerk or deputy clerk.
(c) Member called to order. When a member is called to order by the presiding officer, they shall not proceed without leave of the village board.
(d) Robert's Rules. Meetings of the village board shall be conducted according to
Robert's Rules of Order, Newly Revised, except as otherwise provided herein.
(e) Voting.
(1) Voice vote. The presiding officer may call for a voice vote on any matter not requiring a roll call vote (aye or nay vote) by law. The presiding officer may direct or any member may call for a division.
(2) Aye and nay vote. The ayes and nays may be required by any member and the presiding officer shall call the roll by individual trustee with each subsequent call of the roll beginning with the trustee who voted second on the previous call of the roll and following in the same order until all members have voted. On confirmation and on the adoption of any measure assessing or levying taxes, appropriating money, or creating any liability or charge against the Village or any fund thereof and final action on all ordinances, the vote shall be by ayes and nays. All ayes and nay votes shall be recorded in the minutes.
(3) Members required to vote. Every member present when a question is put shall vote unless the presiding officer, for special reasons, excuses him or her.
Sec. 8.15.080 - Suspension of Rules.
The foregoing rules or any part thereof may be temporarily suspended in connection with any matter under consideration by a vote of two-thirds of the members present.
Sec. 8.15.090 - Reconsideration.
(a) Reconsideration of action taken on a previous meeting agenda item may be requested before the close of the next regularly scheduled village board meeting.
(b) Reconsideration may be requested of an agenda item from the previously regularly scheduled village board meeting only and any special village board meeting that falls between the previous regular board meeting and the next regular scheduled board meeting.
(c) The reconsideration request must be in writing and must have at least two village board members making said request with at least one member of the prevailing side of the vote on the matter for reconsideration.
(d) The motion to reconsider must be placed on the next regularly scheduled village board meeting agenda.
SECTION 2: If any provision of this Ordinance is invalid or unconstitutional, or if the application of this Ordinance to any person or circumstances is found invalid or unconstitutional by a Court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the provisions or application of this Ordinance which can be given effect without the invalid or unconstitutional provision or application.
SECTION 3: All Ordinances and parts of ordinances in conflict herewith are hereby repealed.
SECTION 4: This Ordinance shall take effect and be in full force and effect from and after its passage and publication or posting as required by law.
