By virtue and in execution of the Power of Sale contained in a certain mortgage given by William O. Gardiner, IV to Mackinac Savings Bank, dated August 24, 1999 and recorded in the Worcester County (Worcester District) Registry of Deeds in Book 21767, Page 268, as modified by a certain modification agreement recorded on July 28, 2008, and recorded with said Worcester County (Worcester District) Registry of Deeds in Book 43134, Page 182, of which mortgage the undersigned is the present holder, by assignment from:

for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 11:00 AM on March 13, 2026, on the mortgaged premises located at 69 Zenith Drive, Worcester, Worcester County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
A certain tract of land situated in Worcester, Worcester County, Massachusetts, on the northerly side of Zenith Drive, being shown as Lot D on Revised Plan of land in Worcester, Mass., owned by United Building Company, dated May 28, 1957, Joseph Swartz, Civil Engineer, recorded with Worcester District Registry of Deeds, Plan Book 225, Plan 7, bounded according to said plan as follows:
BEGINNING at the southwesterly corner thereof on said Zenith Drive at Lot E, on said plan;
THENCE N. 0° 41' 21'' W. by said Lot E, One Hundred Twenty-six (126) feet, more or less, to land now or formerly of Israel Halfen, et al;
THENCE South easterly by said Halfen land and land now or formerly of Carl S. Dubin, et al, One Hundred and Fifty-hundredths (100.50) feet, more or less, to Lot C, on said plan;
THENCE S. 0° 41' 21'' E. One Hundred Sixteen (116.0) feet, more or less, to Zenith Drive;
THENCE Westerly by said Zenith Drive, One Hundred (100) feet to the point of beginning ;
Being part of the premises conveyed by United Building Company to Ardmore Homes Co., Inc., by deed dated September 5, 1958, and recorded with the Worcester District Registry of Deeds, Book 3971, Page 375.

These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Ten Thousand ($10,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
