Citation on Petition to Partition
To: Edward C. Mello and to all other persons interested.
A petition has been presented to said Court by Jamie Marie Nelson of Oxford in the County of Worcester representing that she holds an undivided part or share of certain land lying in East Brookfield in said County Worcester and briefly as follows: The land, with buildings thereon, in East Brookfield, Worcester County, Massachusetts situated on the westerly side of Faith Drive and bounded and described as follows: Beginning at the southeasterly corner thereof at a point in the westerly line of Faith Drive which is also the northerly corner of a proposed street to be called Jean Avenue; Thence S. 52 degrees 29' W. by said proposed street 122.15 feet to a point at land now or formerly of Albert Freeman et ux; Thence N. 21 degrees 52' W. 180.63 feet to an iron pin; Thence N. 88 degrees 33' E. 150 feet to an iron pin to the westerly line of Faith Drive; The two preceding courses being by other land now or formerly of Albert Freeman et ux; Thence S. 8 degrees 25' E. by Faith Drive 98 feet to the place of beginning. The comon title to said land is derived under deed of Jamie Marie Nelson to Jamie Marie Nelson and Edward C. Mello dated August 22, 2023 recorded with Worcester South Registry of Deeds, Book 69566 Page 92. Setting forth that she desires that all the aforesaid described part of said land may be sold at private sale not less than Three Hundred Eighty Thousand ($380,000.00) dollars, and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided either at private sale or public auction, and be ordered to distribute the net proceeds thereof. If you desire to object thereto you or your attorney should file a wirtten appearance in said Court at Worcester before ten o'clock in the forenoon on the seventeenth day of March, 2026 the return day of this citation.
