A release of oil and/or hazardous materials has occurred at this location, which is a disposal site (DS) as defined by M.G.L. c. 21E, § 2 and the Massachusetts Contingency Plan, 310 CMR 40.0000. On October 6, 2025, 278-284 Grove Street 2022 LLC recorded with the Worcester Registry of Deeds a First Amendment To Notice of Activity and Use Limitation (AUL) on the DS, pursuant to 310 CMR 40.1070 through 40.1080.
The Amendment to Notice of AUL will limit the following site activities and uses at the DS:
1. Activities and Uses Consistent to maintain No Substantial Hazard Conditions is amended to read as follows:
i. The property will be restricted to prevent trespassers by chain link fencing until such time as the Property is covered with asphalt and/or buildings.
ii. The fencing and cover materials will be inspected and maintained on a monthly basis.
2. Activities and Uses Inconsistent with Maintaining No Substantial Hazard Conditions is amended to read as follows:
i. Removal of fencing prior to providing building or asphalt cover over the Property.
ii. Placing utilities in fill material which have constituents of concern (clean fill corridor).
iii. The property will remain covered with concrete gravel to prevent dust and soil exposure until such time that buildings or asphalt are placed and cover the Property.
3. Obligations and Conditions is amended to read as follows:
i. Obligation IV in the 2011 AUL stated here is removed in its entirety and replaced with Obligation ii: The EPEM must be maintained and periodically monitored to verify operation per the Phase IV Remedy Implementation Plan (RIP). Performance criteria and monitoring frequency for the EPEM are specified in the Phase IV RIP.
ii. All occupied buildings must have a vapor barrier and active or passive venting system to remove vapors beneath the foundation. The design of vapor Exposure Path Elimination Measures (EPEM) and Active Exposure Pathway Mitigation Measure (AEPMM) will be prepared by a Massachusetts Professional Engineer (PE) and include the PE Stamp. The AEPMM should comply with MCP 310 CMR 40.1025(3)D and 40.1026(3)D.
iii. A Light Non-Aqueous Phase Liquid (LNAPL) Management Plan must be prepared by a Licensed Site Professional and implemented prior to the commencement of any activity which is likely to encounter groundwater and/or require dewatering.
iv. Annual Inspection should be made of surface cover. Any repairs made should be documented and records maintained.
