NOTICE OF ACTIVITY AND USE LIMITATION Commercial Property 983 Millbury Street Worcester, Massachusetts Release Tracking Number 2-19784 A release of oil and/or hazardous materials has occurred at this location, which is a disposal site as defined by M.G.L. c. 21E, § 2 and the Massachusetts Contingency Plan, 310 CMR 40.0000. On January 30, 2026, Duva Midstate Rte. 20 Realty Trust, recorded with the Worcester District Registry of Deeds a Notice of Activity and Use Limitation on the disposal site, pursuant to 310 CMR 40.1070 through 40.1080. The Notice of Activity and Use Limitation will limit the following site activities and uses on the above property: (i) Use of the Site as a residence, school, nursery, or daycare; (ii) Any activity, such as excavation, which may disturb the petroleum contaminated soil located five to eight feet below the building floor without the prior development and implementation of a Health and Safety Plan and Soil Management Plan and without being replaced immediately following the completion of the project; (iii) Any activities and uses that may significantly damage the integrity of the concrete floor within the AUL area; and (iv) Any long-term (greater than six months) activity that is likely to disturb petroleum contaminated soil located below the floor in the AUL area.
