CITY OF WINTER VILLE ST A TE OF GEORGIA RESOLUTION TO CALL FOR REFERENDUM SPECIAL ELECTION   TO ORDER A REFERENDUM ELECTION CALLING FOR A REFERENDUM ELECTION TO SUBMIT THE QUESTION OF WHETHER OR NOT THE CITY OF WINTERVILLE, GEORGIA SHALL BE AUTHORIZED TO PERMIT AND REGULA TE PACKAGE SALES BY RETAILERS OF BOTH MALT BEVERAGES AND WINE ON SUNDAYS BETWEEN THE HOURS OF 12:30 PM AND 11:30 PM PURSUANT TO O.C.G.A. § 3-3-7(p)(l); TO AUTHORIZE THE BOARD OF ELECTIONS OF A THENS-CLARKE COUNTY, GEORGIA, TO PERFORM ALL DUTIES AS SUPERINTENDENT OF ELECTIONS ASSOCIATED WITH SAID REFERENDUM AS SET FORTH IN THE CONTRACT FOR ELECTION SERVICES FOR MUNICIPALITIES LOCATED WITHIN A THENS-CLARKE COUNTY, GEORGIA AND PURSUANT TO THE OFFICIAL CODE OF GEORGIA ANNOTATED, SECTION 21-2-45(C). WHEREAS, PACKAGE SALES OF DISTILLED SPIRITS ARE NOT LAWFUL IN THE CITY OF WINTERVILLE, GEORGIA, WHEREAS, THE GOVERNING AUTHORITY OF THE CITY OF WINTERVILLE, GEORGIA DESIRES TO SUBMIT THE QUESTION OF WHETHER OR NOT THE CITY OF WINTERVILLE, GEORGIA SHALL BE AUTHORIZED TO PERMIT AND REGULATE PACKAGE SALES BY RETAILERS OF BOTH MALT BEVERAGES AND WINE ON SUNDAYS BETWEEN THE HOURS OF 12:30 PM AND 11:30 PM PURSUANT TO O.C.G.A. § 3-3-7(p)(l)   NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE GOVERNING AUTHORITY OF THE CITY OF WINTER VILLE, GEORGIA, IHAT; Section 1. A referendum election shall be held in the City of Winterville, Georgia to be conducted by the Athens-Clarke County Board of Elections on Tuesday, November 4, 2025 for the purposes of determining whether or not the City of Winterville, Georgia shall be authorized to permit and regulate package sales by retailers of both malt beverages and wine on Sundays between the h ours of 12:30 PM and 11 :30 PM pursuant to O.C.G.A. § 3-3-7(p)(l);  Section 2. Pursuant to the authority of the Official Code of Georgia Annotated, Section 21-2- 45(c), the Athens Clarke County Board of Elections, Athens Clarke County, Georgia is hereby authorized to conduct said referendum and in conducting thereof shall perform all duties of the superintendent of elections with the exception of qualification of candidates as agreed in that Contract for Election Services for Municipalities located within Athens Clarke County, Georgia by and between the City of Winterville, Georgia and the Athens Clarke County Board of Elections dated February 10, 1999.   SO APPROVED AND RESOLVED this 23rd day of July, 2025.  MAYOR AND CITY COUNCIL OF WINTERVILLE BY: Dodd Ferrelle, Mayor   ATTEST: Wendy Bond Clerk, City of Winterville
