NOTICE OF SALE UNDER POWER
Because of a default under the terms of the Security Deed executed by Tavarius Leon Antonio Johns to Mortgage Electronic Registration Systems, Inc., as Nominee for Vanderbilt Mortgage and Finance, Inc. DBA Silverton Mortgage dated September 22, 2021, and recorded in Deed Book 1804, Page 1131, Richmond County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Planet Home Lending, LLC, securing a Note in the original principal amount of $239,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, October 7, 2025, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
ALL that lot or parcel of land, with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, being shown and designated as Lot 9, Block G, Huntington Subdivision, on a plat recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Reel 20, Pages 171-176; reference being made to said plat for a more complete and accurate description as to the metes, bounds and location of said property.
LESS AND EXCEPT THEREFROM All those pieces or parcels of land situate, lying and being in the State of Georgia, County of Richmond, being described in that certain Deed of Dedication recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Reel 26, Page 1432 and Realty Reel 29, Page 412.
Said property is conveyed subject to and with notice of the following matters: a) drainage easements, building setback lines, and all other matters shown on the plat of record; b) general utility easements and road right-of-way grants and easements.
Said property is hereby conveyed subject to 20' drainage and utility easement as contained on the Plat of Huntington Subdivision, recorded in Plat Book 20, page 171-176 of the Clerks Office of Richmond County, Georgia.
Said property is hereby conveyed subject to Georgia Power Easement recorded in Deed Book 39-H, page 497 of the Clerks Office of Richmond County, Georgia.
Said property is hereby conveyed subject to Deeds of Dedication recorded in Deed Book 26, page 1432 and Deed Book 29, Page 412 of the Clerks Office of Richmond County, Georgia.
Said property is hereby conveyed subject to Protective Covenants applicable to said subdivision of record in aforesaid Clerk's Office in Deed Book 20, Page 1758; Deed Book 31, Page 1602; as amended; and to any and all other easements, restrictions and rights of way of record in the aforesaid Clerk's Office.
Said property is known as 3369 Ravenwood Road, Augusta Road, GA 30907, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
The property is or may be in the possession of Tavarius Leon Antonio Johns, successor in interest or tenant(s).
