NOTICE OF BOND RELEASE In accordance with KRS 350.093, notice is hereby given that ERP Environmental Fund, Inc., 216 School Drive, Shrewsbury, West Virginia 25015, has applied for Phase I bond release on Increment 1 of Permit No. 851-0057, which was last issued on 15 August 2025 (Permit 851-0057 MI-12). The application covers a total area of 38.40 acres, approximately 2.8 miles east of Zion in Henderson County. The permit area is located approximately 1.2 miles north of the KY 351 junction with Chaney Road, and 0.2 mile east of Lick Creek. The bond now in effect for Increment 1 is Bond #N-062017-851-0057-01 in the amount of $169,500. Approximately 59.4% ($100,700) of the current bond amount of $169,500 is included in the application for release. For the Phase I bond release on this increment, the following reclamation steps have been completed: Completion of backfilling, regrading, topsoil replacement, and drainage control including soil preparation and initial seeding and mulching in accordance with the approved reclamation plan. This work was completed in August 2025. Written comments, objections, and requests for a public hearing or informal conference must be filed with the Director, Division of Mine Reclamation and Enforcement, 300 Sower Boulevard, Frankfort, Kentucky 40601, by Friday, 17 October 2025. A public hearing on the bond release application has been scheduled for Tuesday, 21 October 2025 at 9:00 A.M. at the Kentucky Department for Natural Resources (KDNR), Division of Mine Reclamation and Enforcement (DMRE), Madisonville Regional Office, 625 Hospital Drive, Madisonville, Kentucky 42431. The hearing will be cancelled if no request for a hearing or informal conference is received by Friday, 17 October 2025.
