EXECUTION AND ORDER OF SALE
RIO DEL REY HOMEOWNERS ASSOCIATION, an Arizona nonprofit corporation, Plaintiff(s),
vs.
DAVAREN HIGHTOWER, an unmarried man; SECRETARY OF HOUSING AND URBAN DEVELOPMENT, a governmental entity; THE UNKNOWN HEIRS AND DEVISEES OF DAVAREN HIGHTOWER, IF DECEASED, Defendant(s).
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 19th day of June, 2025, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 12th day of March, 2025, the above-named Plaintiff recovered a Judgment in the above-styled Court against the Defendant, above-named, as follows:
Amounts awarded in judgment, accruing interest at rate stated in judgment -- $14,225.74; Pre-judgment interest -- $150.06; Late charges charged on 2024 thru 2025 assessments installments -- $75.00; Interest accrued on judgment through June 10, 2025 -- $321.70; Supplemental attorney fees and costs pending Court approval -- $2,074.10; Less credits or payments applied -- ($1,000.00); Total judgment balance as of June 10, 2025 -- $15,846.60.
Interest will continue to accrue at the rate of $3.47 per diem from June 11, 2025, plus monthly late charges of $15.00 commencing June 2025. Additional assessments will accrue January 1, 2026 in an amount not less that $1,122.00, plus monthly late charges of $15.00, plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendant, on the following described real property, to-wit:
Lot 63, of RIO DEL REY UNIT IV, according to the plat of record in the office of the County Recorder of Maricopa County, Arizona, recorded in Book 639 of Maps, Page 12, and Certificates of Correction recorded in Document No 2004-1084478, Document No. 2004-1084479 and Document No. 2004-1084480, of Official Records.
AKA: 5912 West Wood Street, Phoenix, Arizona 85043.
NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 18th day of September, 2025, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs.
