NOTICE OF SALE NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE Premises: 887 Commercial Street, Provincetown, MA 02657 By virtue and in execution of the Power of Sale contained in a certain mortgage given by James L. Helms to First Horizon Home Loan Corporation, dated June 23, 2003, and recorded with the Barnstable Registry of Deeds in Book 17154 at Page 206, as affected by an assignment of mortgage from First Horizon Home Loan Corporation to Federal National Mortgage Association, a United States Corporation, dated March 30, 2011, and recorded with said Registry in Book 25362 at Page 276, as affected by an assignment of mortgage from Federal National Mortgage Association to Nationstar Mortgage LLC d/b/a Mr. Cooper, dated June 8, 2019, and recorded with said Registry in Book 32076 at Page 33, as affected by an assignment of mortgage from Nationstar Mortgage LLC d/b/a Mr. Cooper to UMB Bank, National Association, not in its individual capacity, but solely as Legal Title Trustee for PRL Title Trust I, dated May 19, 2023, and recorded with said Registry in Book 35799 at Page 227, of which mortgage the undersigned is the present holder by assignment, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold by Public Auction at 11 o’clock A.M. on the 17th day of September 2025 at the mortgaged premises located at 887 Commercial Street, Provincetown, MA 02657, Barnstable County, Massachusetts, all and singular the premises described in said mortgage, To wit: The dwelling unit designated as Unit 1 of the Windswept Colony Condominium, as Condominium situated on Route 6A, Provincetown, Barnstable County, Massachusetts (the Post Office address of which is Massachusetts State Highway, Route 6A, Provincetown, MA 02657), said condominium having been created by a Master Deed date July 1, 1980 and record with Barnstable County Registry of Deeds in Book 3129, Page 001, in accordance with and subject to the provisions of Chapter 183A of the General Laws of the Commonwealth of Massachusetts. Said Unit is conveyed together with the following percentage of undivided interest in the common area and facilities (herein after referred to “the common elements”), set forth as follows: Unit 1: Percentage of Interest 23.00%The said Windswept Colony Condominium is compromised of land with the building improvements and structures thereon shown on plans record in Plan Book 345, pages 3 and 4. The unit is intended to be used for residential purposes only, and is further subject to the provisions of said Chapter 183A as it may be amended from time to time; the restrictions and easements set forth or referred to in the said Master Deed; the Windswept Colony Condominium Trust recorded with Said Registry Book of Deed in Book 3129, Page 014, which provisions (as the same may be duly amended from time to time), shall constitute covenants running with the land and binding upon any person having at any time any interest of estate in the unites, the members of his household, guests and visitors as fully as though such provisions were entirety set forth herein, including any and all rules and regulations adopted pursuant thereto; and such real estate taxes attributable to the units and the percentage of common elements appurtenant thereto for the current year as are not yet due and payable on the date of delivery hereof. Subject to a restriction imposed by the Provincetown Board of Health that no increases in square footage to the dwelling be allowed in the future. Being the same premises conveyed by deed of James L. Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. TERMS OF SALE: A deposit of Ten Thousand Dollars ($10,000.00) by certified or bank check will be required to be paid by the purchaser at the time and place of sale.
