NOTICE OF ACTION TO QUIET TITLE FOR PROPERTY KNOWN AS 2685 BANK ROAD, NANTICOKE, MARYLAND (TAX MAP 63, PARCEL 349; TAX ID NO. 12-003188)
A complaint and amended complaint have been filed in the above-captioned action that seeks to quiet title regarding a .35-acre portion of 2685 Bank Road, Nanticoke, Maryland 21840. 2685 Bank Road is currently identified by SDAT as consisting of 21,780 square feet (1/2 acre), but the deed conveying 2685 Bank Road property to Frederick Elsey from Annie Sordon Lynch on May 11, 1914, recorded among the Land Records of Wicomico County in Liber 109, folio 123, describes 1331 square yards (.275 acres) conveyed to the said Frederick Elsey with 1,694 square yards (.35 acres) retained by the said Annie Sordon Lynch. Plaintiff, Timothy E. Gribbin purchased 2685 Bank Road on September 6, 2024 by deed recorded in the aforesaid Land Records in Liber 5442, folio 459. Although Plaintiff and his predecessors in title have paid taxes on 2685 Bank Road assessed at 1/2 acre, his deed only describes 1331 square yards (.275 acres). Plaintiff's quiet title action is intended to resolve the discrepancy between the State Department of Assessments and Taxation identification of 2685 Bank Road as 1/2 acre with the legal description contained in Plaintiff's deed that identifies 2685 Bank Road as 1331 square yards (.275 acres). Plaintiff requests that an order be issued by the Circuit Court for Wicomico County declaring that plaintiff is the absolute owner of 2685 Bank Road consisting of 1/2 acre and enjoining the defendants from asserting any claim, at law or otherwise, relating to the use, occupancy or possession of 2685 Bank Road or any portion thereof. There are interested parties or potentially interested parties to this action that cannot be served by ordinary means, and this notice is intended as alternative service thereupon pursuant to an Order of Publication issued by the Circuit Court for Wicomico County
The property is described in the tax records as "LOT 21,780 SQFT. 2685 BANK RD NANTICOKE" and is further identified as being on tax map 63, grid 16, parcel 349 and has been assigned Tax ID No. 12-003188. The plaintiff seeks issuance of summonses, an order of publication, entry of judgment and a final order vesting in plaintiff an absolute and indefeasible title to the fee simple interest, in and to 2685 Bank Road at 1/2 acre, and barring all prior or subsequent alienations and descents of the property.
