NOTICE OF SALE UNDER POWER
Because of a default under the terms of the Security Deed executed by Tiffany M Walter and David Smith, Jr. to Mortgage Electronic Registration Systems, Inc., as nominee for New South Federal Savings Bank dated May 15, 2009, and recorded in Deed Book 351P, Page 805, as last modified in Deed Book 3143, Page 646, and pursuant to affidavit recorded in Deed Book 762, Page 771, Chatham County Records, said Security Deed having been last sold, assigned, transferred and conveyed to NewRez LLC d/b/a Shellpoint Mortgage Servicing, securing a Note in the original principal amount of $196,794.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, October 7, 2025, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
ALL THAT CERTAIN LOT, TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN THE 7th G.M. DISTRICT, CHATHAM COUNTY, GEORGIA AND BEING KNOWN AND DESIGNATED AS LOT NUMBER SIXTY-SIX (66) ON THAT CERTAIN PLAT BY EMC ENGINEERING SERVICES, INC., DATED DECEMBER 29, 2003, ENTITLED "SWEETWATER STATION, PHASE 1, A MAJOR SUBDIVISION OF LOT 1 AND PARCEL C OF A RECOMBINATION OF A 180.02 ACRE TRACT OF LAND, 7Th G.M. DISTRICT, SAVANNAH, CHATHAM COUNTY, GEORGIA", RECORDED IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF CHATHAM COUNTY, GEORGIA IN SUBDIVISION MAP BOOK 29-S, PAGES 90-A THROUGH 90-B. SAID PLAT IS INCORPORATED HEREIN BY THIS REFERENCE FOR DESCRIPTIVE AND ALL OTHER PURPOSES. THIS LOT HAS A PROPERTY IDENTIFICATION NUMBER OF 2-1004A-3-23.
SUBJECT, HOWEVER TO ALL VALID EASEMENTS, RESTRICTIONS AND COVENANTS OF RECORD.
THIS IS THE SAME PROPERTY CONVEYED TO ERNEST HOMES, LLC BY WARRANTY DEED DATED JANUARY 20, 2005, AND RECORDED IN DEED BOOK 282-H, PAGE 404, CHATHAM COUNTY, GEORGIA DEED RECORDS.
Said property is known as 11 Steel Magnolia Lane, Savannah, GA 31419, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
The property is or may be in the possession of Tiffany M Walter and The Representative of the Estate of David Smith, Jr., successor in interest or tenant(s).
