PLEASE TAKE NOTICE that Route 73 Property LLC (the "Applicant") has applied to the Evesham Township Zoning Board of Adjustment seeking "D(1)" use variance approval in order to construct additional employee parking for Olga's Diner which will create an additional fourteen (14) parking spaces (the "Application"). A portion of the parking area will be located on the existing diner's lot at 200 Route 73 North, with a portion encroaching onto the adjacent lot, known as 89 Baker Boulevard. These lots are further identified as Block 20, Lot 1.01 and Block 20.01, Lot 1 on the Evesham Township Tax Map, (the "Site") respectively.
200 Route 73 North is located within the Commercial ("C-1")/Evesham Crossroads Overlay ("EVCO") Zoning District and 89 Baker Boulevard is located within the Medium Density ("MD") Zoning District. Seven (7) of the fourteen (14) proposed parking spaces will be located within the MD Zoning District, where the proposed parking area to support a commercial use is not a permitted use as per Township Code §160-64, requiring the Applicant to seek use variance relief. There are no proposed changes to the existing single-family dwelling located at 89 Baker Boulevard.
This is a bifurcated Application and will remain subject to a subdivision approval to divide the portion of 89 Baker Boulevard to be used for parking and consolidate it with the diner property. Although the subdivision application is not yet before the Board, the Applicant calls attention to the following bulk variance relief that would be necessitated if the Application is approved, which relief is integral to this proposal to create the proposed employee parking area:
Regarding Block 20, Lot 1.01 within the C-1 Zoning District:
From §160-68.1F.1 to permit a 4 ft setback, where the minimum front yard parking setback is 50 ft.
From §160-68.1F.1 to permit 73.30% impervious coverage, where the maximum impervious coverage permitted is 60%.
From §160 Attachment 1 to permit a 15 ft landscaping buffer, where the minimum landscape buffer is 30ft to a residential property.
Regarding Block 20.01, Lot 1 within the MD Zoning District:
From §160-13 to permit a 2.19 ft accessory building side yard setback where the minimum setback is 12.5 ft.From §160-32(B)(5) and (6), to permit a 4 ft setback, where the minimum parking setback is 25 ft.
The Applicant also seeks the continuance of previously approved bulk variances, without change, including:
Regarding Block 20, Lot 1.01 within the C-1 Zoning District:
From §160-68.1.F.1 where the minimum front yard setback is 20 ft and 27.2 ft and 16 ft exists.From §160-32.D.2 where 2.74 loading spaces are required and 1 exists.
From §160-68.1F.1 to permit a 4 ft setback, where the minimum front yard parking setback is 50 ft.
Regarding Block 20.01, Lot 1 within the MD Zoning District:
From §160 Attachment 11 where the minimum front yard setback is 30 ft, 29.7 ft exists.
From §160 Attachment 11 where the minimum rear yard setback is 25 ft, 22.5 ft exists.
No further variances have been identified at this time but the Applicant requests any and all other variances, waivers and exceptions as may be required as a result of review and recommendations of the Board or its professional review staff.
