In execution of the Deed of Trust in the original principal amount of $153,082.00 dated July 20, 2017 and recorded as Instrument No. 170006116, of the Augusta County land records, the appointed Substitute Trustee will offer for sale at public auction at the front steps of Circuit Court for Augusta County, 1 E Johnson Street, Staunton, VA 24402 on October 31, 2025 at 10:00AM, the property described in said deed of trust, located at the above address and more particularly described as follows:

All of that certain tract or parcel of land, together with any and all improvements thereon and appurtenances thereto belonging, situate in Pastures District, Augusta County, Virginia, on State Route 720 more particularly described and designated as 1.442 acres on plat entitled "Plat Showing a Division of 11.973 Acres of Land Presently in the name of Earsie S & Mazie I. Ailer", prepared by Barry E. Lotts, P.C., dated April 4, 2002, a copy of which plat is attached hereto and recorded with this instrument.
Parcel 2
All that certain tract or parcel of land, together with all improvements thereon, rights, privileges and appurtenances thereunto belonging or in anywise appertaining, lying and being in the Pastures District of Augusta County, Virginia, containing 0.558 of an acre and shown on plat entitled, "Plat Showing a Boundary Line Adjustment of 2.000 Acres of Land," dated May 24, 2006, made by Lotts, Austin & associates, which plat is attached to and recorded with this deed.

Parcel 1: Being the same property conveyed to Julian G. Flesher by deed from Samuel A. Thomas and Rebecca M. Thomas, husband and wife recorded 06/04/2002 in Deed 020007319, in the Clerk's Office of the Circuit Court of Augusta County, Virginia.
Parcel 2: Being the same property conveyed to Julian G. Flesher by Deed from Daniel J. Payne, Sr. And Cynthia W. Payne, husband and wife recorded 07/11/2006 in Deed 060009050, in the Clerk's Office of the Circuit Court of Augusta County, Virginia.
Subject to all restrictions, rights of way, easements and other conditions contained in deed forming the chain of title to the caption property.
The property and improvements will be sold in “as is” physical condition without warranty of any kind.
TERMS OF SALE: A non-refundable bidder’s deposit of 10% of the sale price or 10% of the original principal amount of the subject Deed of Trust, whichever is lower, by cashier’s or certified check, required at time of sale except for the party secured by the Deed of Trust. Risk of loss on purchaser from date and time of auction. Balance of the purchase price must be paid by cashier’s check within 15 days from sale date. Except for Virginia Grantor’s tax, all settlement costs and expenses are purchaser’s responsibility. Taxes are pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses and attorney’s fees of both sales. If Trustee does not convey title for any reason, purchaser’s sole remedy is return of deposit without interest. This sale is subject to post-sale audit by the Substitute Trustee of the conduct of the auction itself as well as the status of the loan secured by the Deed of Trust, including, but not limited to, determining whether prior to sale a bankruptcy was filed, a forbearance, repayment or other agreement was entered into or the loan was reinstated or paid off; in any such event this sale shall be null and void and purchaser’s sole remedy shall be return of deposit without interest.
