By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Timothy Dormady and Samantha Dormady to Sovereign Bank, dated August 2, 2005 and recorded in Plymouth County Registry of Deeds in Book 31097, Page 70 (the “Mortgage”), as affected by a Loan Modification Agreement dated March 23, 2016, and recorded at said Registry of Deeds in Book 46961, Page 80, and further affected by a Loan Modification Agreement dated December 14, 2017, and recorded at said Registry of Deeds in Book 50755, Page 210, and further affected by a Loan Modification Agreement dated January 9, 2020, and recorded at said Registry of Deeds in Book 52421, Page 170 of which mortgage U.S. Bank Trust National Association Not In Its Individual Capacity But Solely As Owner Trustee For RCAF Acquisition Trust is the present holder by Assignment from Santander Bank, N.A.formerly known as Sovereign Bank to MTGLQ Investors, L.P. dated September 12, 2014 and recorded at said Registry of Deeds in Book 45209, Page 105, and Assignment from MTGLQ Investors, L.P. to U.S. Bank Trust National Association Not In Its Individual Capacity But Solely As Owner Trustee Of Legacy Mortgage Asset Trust 2020-GS5 dated February 2, 2021 and recorded at said Registry of Deeds in Book 54922, Page 300, and Assignment from U.S. Bank Trust National Association Not In Its Individual Capacity But Solely As Owner Trustee Of Legacy Mortgage AssetTrust 2020-GS5 to U.S. Bank Trust National Association Not In Its Individual Capacity But Solely As Owner Trustee For RCAF Acquisition Trust dated October 14, 2024 and recorded at said Registry of Deeds in Book 59473, Page 251, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 197 East Street, Duxbury, MA 02332 will be sold at a Public Auction at 10:00 AM on September 22, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
The land together with the buildings thereon in Duxbury, Plymouth County, Massachusetts, located on the southerly side of East Street, said parcel containing 1.92 acres more or less and being bounded and described as follows:
Beginning at a stake and stones at the northwest corner of land formerly of Leander & Gradner one hundred forty-two (142) feet to a stake and stones; thence in the same course of land now or formerly of David W. Nightingale two hundred forty-eight (248) feet to a stake and stone, thence S. 58" 20'W. by land now or formerly of Lucinda Anderson sixty-nine (69) feet to a stake and stone; thence S. 55" 25' W. by land now or formerly of Lot Phillips Co. ninety-four (94) feet to a stake and stones; thence N. 14 deg. 35' W. by land now or formerly of Jonathan Ford at al four hundred thirty-five (435) feet to a stake and stones on the south side of East Street; thence N. 78 deg. 35' E. by East Street two hundred sixty-six and 5/10 (266.5) feet to the point of beginning.

The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $10,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
