NOTICE OF SUBSTITUTE TRUSTEE’S SALE   35 Hermitage Ave., 43 Hermitage Ave., 45 Hermitage Ave., 28 Middleton St., 30 Middleton St., 40 Middleton St., 623 President Ronald Reagan Way, 625 President Ronald Reagan Way, 627 President Ronald Reagan Way, 34 Rutledge St., and 42 Rutledge St., Nashville, Davidson County, Tennessee   Default having been made in the terms, conditions, and payments, including without limitation the failure to make principal and interest payments, provided for in that certain Deed of Trust, Assignment of Leases and Security Agreement dated December 14, 2021, and recorded December 29, 2021 as Instrument Number 20211229-0171275, in the Register’s Office for Davidson County, Tennessee, as amended by that certain Modification of Deed of Trust, Assignment of Leases and Security Agreement dated December 30, 2021, and recorded January 20, 2022 as Instrument Number 20220120-0007757 in said Register’s Office, as amended by that certain Modification of Deed of Trust, Assignment of Leases and Security Agreement dated November 8, 2022, and recorded November 14, 2022 as Instrument Number 20221114-0120971 in said Register’s Office, as amended by that certain Modification of Deed of Trust, Assignment of Leases and Security Agreement dated September 27, 2024, and recorded October 8, 2024 as Instrument Number 20241008-0078057 in said Register’s Office, and as further amended by that certain Modification of Deed of Trust, Assignment of Leases and Security Agreement dated February 21, 2025, and recorded March 27, 2025 as Instrument Number 20250327-0022826 in said Register’s Office from Rutledge Hill, LLC, a Delaware limited liability company (“Borrower”) to John C. McDearman, III, Trustee, securing the indebtedness therein described (as amended, the “Deed of Trust”), which indebtedness is now due and unpaid, and has been declared in default by the lawful owner and holder thereof;   On August 11, 2025, Thomas S. Davidson of Davidson County, Tennessee was appointed Substitute Trustee to serve in the place and stead of John C. McDearman, III, Trustee, said appointment being recorded on August 15, 2025 in the Register’s Office for Davidson County, Tennessee as Instrument Number 20250815-0065294;   NOW, THEREFORE, I, Thomas S. Davidson, Substitute Trustee, pursuant to said Deed of Trust, having been requested by Wilson Bank & Trust, the owner and holder of said indebtedness, so to do, and by virtue of the authority and power vested in me by said Deed of Trust will, on October 21, 2025, on or about 12:00 noon, at the Davidson County Historic Courthouse, Nashville, Tennessee, proceed to sell at public outcry to the highest bidder for cash (or credit upon the indebtedness secured if the lawful owner and holder thereof is the successful purchaser), free from the equity of redemption, statutory right of redemption, homestead, dower, curtesy, and all other rights or exemptions of every kind, all of which have been expressly waived by Borrower in said Deed of Trust, the property in Davidson County, Tennessee described as follows:   PARCEL A:   Tract 1: (34 Rutledge St., Nashville, TN 37210; Map/Parcel No. 093-11-0-181.00)   Land in Davidson County, Tennessee, being Lot No. 44, 45, 46, 47, 48 and 49 on the Plan of Rutledge's Addition to Nashville of record in Plat Book 21, Page 73, in the Register's Office for Davidson County, Tennessee, and described according to an unrecorded survey by Barry Greer & Associates dated June 7, 1976, and revised November 10, 1977 as follows:   Beginning at an iron pin set at the intersection of the South right-of-way of Lea Avenue and the East right-of-way of Rutledge Street and proceeding as follows: With said right-of-way of Lea Avenue, N 59 deg. 00 min. E, 273.16 feet to an iron pin set in the South right-of-way of a 15' alley; thence with the right-of-way of said alley, S 64 deg. 39 min. E, 181.42 feet to a P-K nail set at the intersection with the North right-of-way of Rutledge Street; thence, with said right-of-way, N 30 deg. 38 min.
