COMMON COUNCIL MEETING

MINUTES
The regular Mtg of the Franklin Common Council was held on August 19, 2025, and was called to order at 6:30 p.m. by Mayor John R. Nelson in the Franklin City Hall Council Chambers, 9229 W. Loomis Rd, Franklin, WI. On roll call, the following were present: Ald Eichmann, Hasan, Salous, Day and Craig. Ald Peccarelli was excused. Also in attendance were Director of Admin Kelly Hersh, City Atty Jesse A. Wesolowski and Deputy City Clerk Maggie Poplar.
Citizen comment period was opened at 6:31 p.m. and was closed at 6:33 p.m.
Mayor Nelson Presented a Proclamation in Recognition of the Franklin Health Department.
Ald Hasan moved to approve the minutes of the Common Council Mtg of August 5, 2025, as presented. All voted Aye; motion carried.
Ald Day moved to place on file the certificate designating the Franklin HD as a Level III Health Department. All voted Aye; motion carried.
Ald Eichmann moved to receive the 2024 Annual Review by Forward Appraisal and place on file. All voted Aye; motion carried.
Ald Eichmann moved to adopt Res No. 2025-8365, a Resolution to issue Landmark Structures I, LP a CO No. 3 for Elevated Water Storage Tank (Contract B) at 8120 S. Lovers Lane Rd (TKN 801-9986-000) in the amount of $19,963.31. All voted Aye; motion carried.
Ald Eichmann moved to adopt Res No. 2025-8366, a Resolution to authorize Professional Services Contract with Ruekert & Mielke, Inc. to Provide SCADA Programming and Integration Services for the new elevated Water Storage Tank for a fee of $25,000. All voted Aye; motion carried.
Ald Hasan moved to adopt Res No. 2025-8367, a Resolution to Authorize Professional Services Contract with Ruekert & Mielke, Inc. to Conduct a Water System Storage Capacity Analysis for a fee of $34,304. All voted Aye; motion carried.
Ald Eichmann moved to adopt Res No. 2025-8368, a Resolution to approve Addendum No. 4 in the amount of $30,000-$35,000 to Foth Infrastructure and Environment, LLC, with corrections by the City Engineer. All voted Aye; motion carried.
Ald Craig moved to adopt Res No. 2025-8369, a Resolution for authorization to We Energies for work order to install two street lights in the Cape Crossing Phase 3 Subdivision. All voted Aye; motion carried.
Ald Eichmann moved to adopt Res No. 2025-8370, a Resolution Conditionally Approving a Two-Lot Certified Survey Map, being a Redivision of Certified Survey Map No. 3990 in the SE ¼ and NE ¼ of the SW ¼ of Section 8, Town 5 N, Range 21 E, City of Franklin, Milw County, WI (Megna Living Trust, Property Owner) (Steve Rolfe, Midland Commercial Development Corporation, Applicant) (10001 W. Church St). All voted Aye; motion carried.
Ald Day moved to adopt Res No. 2025-8371, a Resolution authorizing the Franklin FD to execute an agreement with Digitech Computer, LLC for Ambulance Billing Services. All voted Aye; motion carried.
Ald Hasan moved to approve the FD to accept a grant in the amount of $1,554 from the We Energies Foundation for the purchase of gas leak detection meters. All voted Aye; motion carried.
Ald Eichmann moved to approve the sale of "Official St. Martins Fair" apparel by Wiki Wares & More LLC for the 2025 St. Martins Fair with a portion of the proceeds donated back to St. Martins Fair. All voted Aye; motion carried.
Ald Day moved to adopt Ord No. 2025-2696, an Ordinance to Repeal Chapter 167 Sex Offenders and Recreate Chapter 167 Entitled Sex Offender Residency Restrictions and Child Safety Zones, of the Municipal Code of Franklin, WI. On roll call Ald Eichmann, Hasan, Day and Salous all voted Aye, Ald Craig voted No. Motion carried.
Ald Eichmann moved to enter closed session at 8:15 p.m., pursuant to Wis. Stat.§ 19.85(1)(g), to confer with legal counsel for the Common Council who is rendering advice concerning strategy to be adopted by the body with respect to the subject litigation, and to reenter open session at the same place thereafter to act on such matters discussed therein as it deems appropriate. On roll call, all voted Aye. Motion carried. Upon reentering open session at 8:39 p.m., Ald Eichmann moved to proceed with retaining Landretti and Company, LLC out of Middleton WI as a Professional Consultant. All voted Aye; motion carried.
Ald Eichmann moved to approve the following licenses of the License Committee Mtg of August 19, 2025.
Grant 2025-26 New Operator License to Daniel Buschmann, Joseph Kelly, Ritika Kwatra, Samuel Zaniewski, Jessica Zuelzke; Grant 2025-26 Day Care License to: Cadence Education, LLC, DBA Discover Days of Franklin, 9758 S Airway Ct, Kristen Allen-On Site Director/Manager; Cadence Education, LLC, DBA Kids Connection of Rawson, 6350 S 108th St, Katherine Kooi-On Site Director/Manager; and
Grant Temporary Entertainment & Amusement to Franklin Health Department, Ellen Henry, Trunk or Treat, Public Library-9151 W Loomis Rd, 10/23/25, 3-9:00 PM. All voted Aye; motion carried.
Ald Hasan moved to approve City vouchers with an ending date of August 14, 2025 in the amount of $2,039,599.65, and payroll dated August 8, 2025 in the amount of $461,937.12 and payments of the various payroll deductions in the amount of $255,532.18 plus City matching payments, and estimated payroll dated August 22, 2025 in the amount of $496,000 and payments of the various payroll deductions in the amount of $557,000, plus City matching payments. On roll call, all voted Aye. Motion carried.
Ald Hasan moved to adjourn the Mtg of the Common Council at 8:41 p.m. All voted Aye; motion carried.
