Public notice is hereby given of the Chapter 91 License application by the Town of Upton for a proposed Infrastructure Crossing Facility, stormwater drainage, and shoreline stabilization including improvement dredging within Center Brook at 0 Grove Street Right of Way, 7 and 8 Grove Street, and 2 Main Street in Upton, Worcester County. The project has preliminarily been determined to be a Water-Dependent Use. The second notice and comment period for this project are to address a notification deficiency – there has been no change to the project from the initial notice.
The Department will consider all written comments on this application received October 9, 2025 (Public Comments Deadline). Failure of any aggrieved person or group of ten (10) citizens or more to submit written comments to the Waterways Regulation Program by the Public Comments Deadline will result in the waiver of any right to an adjudicatory hearing in accordance with 310 CMR 9.13(4)(c). The group of citizens must include at least five (5) citizens who are residents of the municipality in which the proposed project is located. A public hearing may be held at the request of the Municipal Official.
