AN ORDINANCE TO REZONE ALL, OR PORTIONS OF, THE PROPERTIES LOCATED AT 7412, 7430, 7478, 7546, 7610, 7628, AND 7640 S. 27TH ST. FROM RS-1 SINGLE-FAMILY RESIDENTIAL DISTRICT, RS-2 SINGLE-FAMILY RESIDENTIAL DISTRICT, RD-1 TWO-FAMILY RESIDENTIAL DISTRICT, ER EQUESTRIAN RESIDENTIAL DISTRICT, B-4 GENERAL BUSINESS DISTRICT TO RM-1 MULTI-FAMILY RESIDENTIAL DISTRICT.

WHEREAS, the property owner representative, Brian Konyn, Walden OC, LLC, and future developer representative, Mark Lake, OC 27, LLC, have applied to rezone the properties located at 7412, 7430, 7478, 7546, 7610, 7628, and 7640 S. 27th St. from Rs-1 Single-Family Residential District, Rs-2 Single-Family Residential District, Rd-1 Two-Family Residential District, ER Equestrian Residential District, B-4 General Business District to Rm-1 Multi-Family Residential District; and,
WHEREAS, the Plan Commission reviewed said application at its July 22, 2025 meeting and recommended that the rezoning of the properties at 7412, 7430, 7478, 7546, 7610, 7628, and 7640 S. 27th St. to Rm-1 Multi-Family Residential District be approved; and,
WHEREAS, the Common Council held a public hearing on said application on September 2, 2025, at which time all interested parties appeared and were heard; and,
WHEREAS, following said public hearing, with the favorable recommendation of the Plan Commission, and having determined that the proposed rezoning is consistent with the Comprehensive Land Use Plan of the City of Oak Creek, the Common Council is of the opinion that the best interests of the City of Oak Creek would be served if the Rm-1 Multi-Family Residential District rezoning of the properties located at 7412, 7430, 7478, 7546, 7610, 7628, and 7640 S. 27th St. were approved for the lands described below.
NOW, THEREFORE, BE IT RESOLVED, the Common Council of the City of Oak Creek does hereby ordain as follows:
SECTION I. To promote the general welfare, public safety and general planning within the City of Oak Creek, the properties located at 7412, 7430, 7478, 7546, 7610, 7628, and 7640 S. 27th St., legally described below, are hereby rezoned from Rs-1 Single-family Residential District, Rs-2 Single-Family Residential District, Rd-1 Two-Family Residential District, ER Equestrian Residential District, B-4 General Business District to Rm-1 Multi-Family Residential District, and the Zoning Map of Chapter 17 of the Municipal Code is amended to reflect the rezoning:
Being a part of the Northwest 1/4 and Southwest 1/4 of Section 7, Township 5 North, Range 22 East, in the City of Oak Creek, Milwaukee County, Wisconsin, described as follows:
Commencing at the southwest corner of the Northwest 1/4 of said Section 7; Thence North 89°09'56" East along the south line of said Northwest 1/4, 95.01 feet to the east right of way line of South 27th Street - State Trunk Highway "241" and the Point of Beginning;
Thence the following courses along the east right of way line of said South 27th Street:

SECTION II. The terms and provisions of this ordinance are severable. Should any term or provision of this ordinance be found to be invalid by a court of competent jurisdiction, the remaining terms and provisions shall remain in full force and effect.
SECTION III. All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.
SECTION IV. This ordinance shall take effect and be in force from and after its passage and publication.
