AN ORDINANCE TO ESTABLISH/REZONE ALL, OR PORTIONS OF, THE PROPERTIES LOCATED AT 7430, 7478, AND 7546 S. 27TH ST. TO PLANNED UNIT DEVELOPMENT OVERLAY DISTRICT (PUD).
(TAX KEY NOS. 762-9992-003, 762-9991-003, 785-9999-003)

WHEREAS, the property owner representative, Brian Konyn, Walden OC, LLC, and future developer representative, Mark Lake, OC 27, LLC, have applied to establish a Planned Unit Development (PUD) for a multi-family development on the properties at 7430, 7478, and 7546 S. 27th St.;
WHEREAS, the Plan Commission reviewed said application at its July 22, 2025 meeting and recommended that the establishment of/rezoning of all, or portions of, the properties located at 7430, 7478, and 7546 S. 27th St. to Planned Unit Development Overlay District (PUD) be approved; and,
WHEREAS, the Common Council held a public hearing on said application on September 2, 2025, at which time all interested parties appeared and were heard; and,
WHEREAS, following said public hearing, with the favorable recommendation of the Plan Commission, and having determined that the proposed establishment of/rezoning is consistent with the Comprehensive Land Use Plan of the City of Oak Creek, the Common Council is of the opinion that the best interests of the City of Oak Creek would be served if the Planned Unit Development Overlay District (PUD) rezoning of the properties located at 7430, 7478, and 7546 S. 27th St. were approved for the lands described below.
NOW, THEREFORE, BE IT RESOLVED, the Common Council of the City of Oak Creek does hereby ordain as follows:
SECTION I. To promote the general welfare, public safety and general planning within the City of Oak Creek, all of or portions of the properties located at 7430, 7478, and 7546 S. 27th St., legally described below, are hereby rezoned to Planned Unit Development Overlay District (PUD), and the Zoning Map of Chapter 17 of the Municipal Code is amended to reflect the rezoning:
Being a part of Lots 1 and 2 of Certified Survey Map No. 354, as recorded in the Register of Deeds office for Milwaukee County as Document No. 4157677 and additional lands in the Southwest 1/4 and the Northwest 1/4 of Section 7, Township 5 North, Range 22 East, in the City of Oak Creek, Milwaukee County, Wisconsin, described as follows:
Commencing at the northwest corner of the Northwest 1/4 of said Section 7;Thence North 89°09'56" East along the south line of said northwest 1/4, 95.01 feet to the east right of way line of South 27th Street - State Trunk Highway "241";Thence South 00°02'32" East along the east right of way line of said South 27th Street, 221.00 feet; Thence North 89°57'28" East, 165.00 feet; Thence North 85°30'54" East, 142.00 feet; Thence North 84°24'34" East, 103.00 feet; Thence North 84°24'34" East, 202.00 feet to a point of curvature; Thence Northeasterly 370.65 feet along the arc of said curve to the left, whose radius 575.00 feet and whose chord bears North 66°09'30" East, 364.26 feet; Thence North 47°41'31" East, 101.62 feet to a point of curvature; Thence Northeasterly 315.83 feet along the arc of curve to the right, whose radius 475.00 feet and whose chord bears North 66°44'24" East, 310.05 feet to a point on a curve and the Point of Beginning; Thence Northeasterly 27.90 feet along the arc of curve to the right, whose radius 475.00 feet and whose chord bears North 87°28'15" East, 27.89 feet; Thence North 89°09'12" East, 371.31 feet to a point on a curve; Thence Southeasterly 28.99 feet along the arc of said curve to the right, whose radius is 582.21 feet and whose chord bears South 01°18'46" East, 28.99 feet; Thence South 00°06'29" West, 110.95 feet to the aforesaid south line of said Northwest 1/4;Thence South 00°10'39" West, 1078.01 feet to the south line of said Lot 2; Thence South 89°05'18" West along said south line, 946.12 feet; Thence North 00°54'42" West, 227.00 feet to a point of curvature; Thence Northeasterly 461.98 feet along the arc of said curve to the right, whose radius is 208.00 feet and whose chord bears North 62°42'59" East, 372.71 feet; Thence North 54°35'05" East, 270.00 feet Thence North 00°10'39" East, 672.00 feet to the Point of Beginning;
Containing 723,049 square feet (16.5989 acres) of land Gross, more or less.
BE IT FURTHER RESOLVED that said Planned Unit Development Overlay District (PUD) is subject to the Conditions and Restrictions recommended for approval by the Plan Commission on August 26, 2025, attached hereto and incorporated herein by reference. No alteration or modification of the approved Conditions & Restrictions shall be permitted without approval by the Common Council.
SECTION II. The terms and provisions of this ordinance are severable. Should any term or provision of this ordinance be found to be invalid by a court of competent jurisdiction, the remaining terms and provisions shall remain in full force and effect.
SECTION III. All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.
SECTION IV. This ordinance shall take effect and be in force from and after its passage and publication.
