CITY OF NEW BEDFORD MASSACHUSETTS ZONING BOARD OF APPEALS
The Zoning Board of Appeals will hold an Advertised Public Hearing on Thursday, September 18, 2025, at 6:00 PM at Brooklawn Community Center, 1997 Acushnet Ave., New Bedford, MA on the following appeals set forth under the provisions of the City Code of New Bedford:
#4651 Notice is given of a public hearing on the petition of: Bridge Real Estate Investors, LLC, Fish Island Properties LLC, (167 Huttleston Avenue, Fairhaven, MA 02719), Michael McVeigh, Esq. (50 Homers Wharf, New Bedford, MA 02740) for a Special Permit under Chapter 9, Comprehensive Zoning sections 2000 (use & dimensional regulation), 2400 (nonconforming uses & structures), 2410 (applicability), 2430 (nonconforming structures, other than single-and two family structures) 2431 (reconstructed, extended or structurally changed), 2432 (altered to provide for a substantially different purpose or for the same purpose in a substantially different manner or to a substantially greater extent) 5000 (administration & procedures), 5300-5390 (special permit); relative to the property located at NS Fish Island, Assessors’ Map 60, Lots 1 & 30 in a Waterfront Industrial [WI] zoned district. The petitioner is proposing to construct a 3,228+ sq ft commercial addition connecting two existing buildings per plans filed.
#4652 Notice is given of a public hearing on the petition of: SEMCOA INC., c/o Daniel S. Mumbauer (72 Kilburn Street, New Bedford, MA 02740), for an Administrative Appeal under Chapter 9, Comprehensive Zoning Sections 5000 (administration and procedures), 5220 (zoning board of appeals), 5220 (power: the board of appeals shall have and exercise all the powers granted to it by M.G.L.A c. 40A, c. 40B, and c. 41 and by this ordinance. The boards’ powers are as follows: 5223 – to hear and decide appeals taken by one person aggrieved by reason of his inability to obtain a permit or enforcement action from any administrative officer under the provisions of M.G.L.A c. 40A, §§ 7,8 and 15; relative to the property located at 105 South Street, Assessors’ Map 36, Lot 293 in a Residential B [RB] zoned district. The petitioner is seeking a reasonable accommodation under the Americans with Disabilities Act, the Fair Housing Act, and Section 504 of the Rehabilitation Act, to operate a substance-free lodging house for up to eight (8) women. The applicant is appealing a determination made by the Zoning Enforcement Officer that operating a lodging house in a Residential B [RB] zoning district is in violation of the local Zoning Ordinance.
