By virtue of and in obedience to a directed to me by the Honorable ASCENSION 23RD JUDICIAL DISTRICT COURT in and for the PARISH OF ASCENSION, State of Louisiana, dated: Thursday, August 22, 2024, in the above entitled and numbered cause, I shalI proceed to sell at public auction at Governmental Annex 828 South Irma Blvd Gonzales, LA 70737 of which the Civil District Court of the Parish of Ascension is held on WEDNESDAY, OCTOBER 15, 2025, at 10:00 AM, to the last and highest bidder for cash, the following described property, to wit:
PLAINTIFF'S MORTGAGE AND/OR PRIVILEGE AFFECTS THE FOLLOWING DESCRIBED PROPERTY, TO-WIT:
A CERTAIN LOT OR PARCEL OF GROUND, TOGETHER WITH ALL THE BUILDINGS AND IMPROVEMENTS THEREON AND ALL THE RIGHTS, WAYS, PRIVILEGES, SERVITUDES, APPURTENANCES AND ADVANTAGES THEREUNTO BELONGING OR IN ANYWISE APPERTAINING, SITUATED IN THAT SUBDIVISION OF THE PARISH OF ASCENSION, STATE OF LOUISIANA, KNOWN AS OAK HARBOR ESTATES AND BEING DESIGNATED ACCORDING TO THE "PLAT OF SURVEY FOR BLYTHE INVESTMENTS, INC., SHOWING A PARCEL OF LAND IN SECTIONS 41 AND 42, TOWNSHIP 8 SOUTH, RANGE 3 EAST, SOUTHEASTERN LAND DISTRICT", MADE BY S. G. DAVIES, C.E., DATED JANUARY 10, 1962, A COPY OF WHICH IS ON FILE AND OF RECORD IN THE OFFICE OF THE CLERK AND RECORDER OF SAID PARISH, AS LOT NUMBER TWENTY-FOUR (24), SAID OAK HARBOR ESTATES, SAID LOT BEING IRREGULAR IN SHAPE AND MEASURING 100 FEET (IN TWO SEGMENTS, ONE OF 60 FEET AND THE OTHER OF 40 FEET) FRONT ALONG THE EASTERLY SIDE OF DUCROS LANE AND HAVING A DEPTH OF 270 FEET ALONG ITS NORTHERLY SIDE LINE AND ITS SOUTHERLY SIDE LINE CONSISTING OF TWO STRAIGHT LINES (ONE MEASURING 119 FEET AND THE OTHER MEASURING 45 FEET) MEASURING 164 FEET AND AN ADDITIONAL DISTANCE ALONG THE NORTHEASTERLY EDGE OF THE "POND" TO THE EASTERLY EDGE OF THE WATERWAY SHOWN ON SAID MAP, AND THE REAR OR EASTERLY LINE OF SAID LOT BEING THE WESTERLY LINE OF SAID WATERWAY, AND SAID LOT BEING SUBJECT TO THE RIGHT-OF-WAY 10 FEET IN WIDTH PROVIDING THE PROPERTY OWNERS IN OAK HARBOUR ESTATES ACCESS FROM SAID DUCROS LANE TO SAID POND - ALL AS SHOWN ON SAID MAP; AND BEING A PORTION OF THAT PROPERTY ACQUIRED BY BLYTHE INVESTMENTS, INC., FROM ELMER C. ATKINSON ON OCTOBER 16, 1959, AS PER THE DEED WHICH IS RECORDED IN CONVEYANCE BOOK 148, UNDER FILE #60489, OF THE RECORDS OF SAID PARISH OF ASCENSION; SUBJECT TO RESTRICTIONS, SERVITUDES, RIGHTS-OF-WAY AND OUTSTANDING MINERAL RIGHTS OF RECORD AFFECTING THE PROPERTY.
And from the proceeds of said sale to pay petitioner by preference over all other claims, the sum of: ONE HUNDRED TWENTY TWO THOUSAND FIVE HUNDRED FORTY DOLLARS AND SIXTY CENTS ($122,540.60) DOLLARS, along with
interest and attorney's fees and all other costs including my own costs and charges.
