LONE PINE CORP. – OFFER TO PURCHASE PROPERTY IN LIEU OF CONDEMNATION
TAKE NOTICE THAT the Township Administrator of Freehold Township (the "Township") has submitted a written offer to purchase certain property owned by Lone Pine Corp. On or about September 5, 2025, the Township sent offer letters to Lone Pine Corp. to purchase portions of the Lone Pine Landfill, Monmouth County Block 91, Lots 51-54, with a street address of 1091 Burke Rd, Freehold, NJ 07728 (the "Property"). The Property is located within a designated redevelopment area where the Township is authorized to utilize its condemnation power under the New Jersey Local Redevelopment & Housing Law, N.J.S.A. 40A:12A-1, et seq. and the Eminent Domain Act of 1971, N.J.S.A. 20:3-1, et seq. ("EDA"). Please note that the Township does not desire to acquire other property owned by Lone Pine Corp. other than Block 91, Lots 51-54.
If Lone Pine Corp. and the Township cannot arrive at an agreement for the voluntary sale of the Property through bona fide negotiations, the Township will acquire the Property in accordance with the EDA, as authorized by Ordinance No. O-25-15 adopted by the Township Committee on May 13, 2025. The Township seeks to avoid costly and time-consuming litigation that would otherwise be necessary to acquire the Property through the eminent domain process.
The Property to be acquired by the Township has been appraised according to law by a competent real estate appraiser who has determined the fair market value for the Property to be $170,000.00. The Township hereby offers the above-referenced amount of compensation ($170,000.00), less costs of environmental remediation, if any. This offer of compensation is conditional upon delivery of title free and clear of all liens and encumbrances and insurable at regular rates by a title insurance company acceptable to the Township and doing business in the State of New Jersey.
Any representative of Lone Pine Corp. must promptly reply to the Township Administrator of Freehold Township as to whether Lone Pine Corp. wishes to proceed with a voluntary acquisition of the Property. Pursuant to N.J.S.A. 20:3-6, a rejection of this offer or failure to accept the same within fourteen (14) days from the mailing of the offer, shall be conclusive proof of the inability to acquire the Property thereof through bona fide negotiations.
