Whereas, Abby Lawrence, who acquired title as a married woman, now single, by Deed of Trust (the "Deed of Trust"), dated 2/28/2018 and of record in Deed Book 1655, Pages 1450-1471, and as Instrument Number 2134491, in Register's Office of Rutherford County, Tennessee, conveyed to Mark Rosser, Trustee, and the subject Deed of Trust was modified by Loan Modification recorded as Instrument No. 2457190, in Book 2270, Pages 3561-3569 and recorded on 08/09/2022, and further modified by Loan Modification recorded as Instrument No. 2482372, in Book 2316, Pages 3193-3201, and recorded on 2/7/2023, and further modified by Loan Modification recorded as Instrument No. 2523340, in Book 2395, Pages 2099-2107, and recorded on 11/29/2023, and further modified by Loan Modification recorded as Instrument No. 2545737, in Book 2438, Pages 2255-2263, and recorded on 05/23/2024, and further modified by Loan Modification recorded as Instrument No. 2570089, in Book 2487, Pages 1365-1373, and recorded on 11/12/2024, the hereinafter described real property to secure the payment of a certain Promissory Note (the "Note") described in the Deed of Trust, which Note was payable to Freedom Mortgage Corporation, and subsequently assigned to Freedom Mortgage Corporation, and Whereas, Nestor Solutions of Tennessee, LLC has been duly appointed Substitute Trustee by the owner and holder of the Note by instrument recorded in Deed Book 2567, Pages 1382-1384, and as Instrument Number 2610819 in Register's Office of Rutherford County, Tennessee; and Whereas, default has been made in the payment of the Note; and Whereas, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of the indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust. The notice requirements of T.C.A. §35-5-101 and 35-5-104 have been satisfied.
