NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by William J. Davin and Dorothy Davin, to World Savings Bank, FSB, dated September 14, 2007, and recorded with the Worcester County (Worcester District) Registry of Deeds in Book 41816 at Page 354, of which mortgage the undersigned is the present holder by assignment from Wells Fargo Bank, N.A., s/b/m Wells Fargo Bank Southwest, N.A., f/k/a Wachovia Mortgage, FSB, f/k/a World Savings Bank, FSB to MTGLQ Investors, L.P., dated June 14, 2019, and recorded with the Worcester County (Worcester District) Registry of Deeds in Book 60550, Page 395; and by an assignment from MTGLQ Investors, L.P., to U.S. Bank Trust National Association, as Trustee of the Chalet Series IV Trust, dated August 15, 2019, and recorded with the Worcester County (Worcester District) Registry of Deeds in Book 60954, Page 23, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 10:00 A.M. on the 1st day of October, 2025, at 7 Dawson Road, Worcester, MA 01602, all and singular the premises described in said mortgage,
To wit:
The land with the buildings thereon, situated in said Worcester, bounded and described as follows:
Situated on the northwesterly side of Dawson Road.
BEGINNING at a stone monument on the northwesterly line of Dawson Road and at the southeasterly corner of land now or formerly of Fannie E. Miller and running
THENCE N. 69° 3' W. by land now or formerly of said Fannie E. Miller three hundred and eighty-two and 2/10 (382.2) feet;
THENCE S. 11° 5' E: fifty-seven and 77/100 (57.77) feet to the northwesterly corner of land conveyed by Daniel J. Coffey to Otto H. Johnson et ux;
THENCE s. 61° 15' E. by said land so conveyed to said Johnson et ux three hundred and forty-five and 2/10 (345.2) feet;
THENCE northeasterly by a curve, the radius of which is four hundred and seventy (470) feet, and by Dawson Road, ninety-five and 93/100 (95.93) feet to the place of beginning.
Containing about 26,016 square feet, and being designated as Lot No. 2 on a plan of land in Worcester, Mass. owned by Daniel J. Coffey, dated August 13, 1924, and recorded in Worcester District Deeds, Book 2347, Page 52. Subject to restriction as set forth in deed from Bert H. Prior to Daniel J. Coffey, dated March 1, 1922, and recorded with said Deeds, Book 2264, Page 254, that no building shall be erected within 25 feet of said Dawson Road.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of ten thousand dollars ($10,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by wire transfer to Demerle & Associates P.C., 10 City Square, 4th Floor, Boston, MA 02129 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
